Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting all correspondence, including emails, agendas, records of meetings, minutes of meetings, participants lists and any other reports of such meetings between officials/representatives of INEA and CEPS, a.s. between 26 April 2017 and 26 January 2018.

Subject:       Your 23 applications for access to documents submitted
between 3 and 11 April via AsktoEU.org

We were informed that you submitted 23 applications for access to
documents via AsktheEU.org  between 3 and 11 April 2018.  In your
applications, you request access to "all correspondence, including emails,
agendas, records of meetings, minutes of meetings, participants lists and
any other reports of such meetings between officials/representatives of
INEA" and 30 different entities "between 26 April 2017 and 26 January
2018."

We are being analysing your requests and some of the applications concern
a very large number of documents, which need to be assessed individually.
Such a detailed analysis cannot be carried out within the normal time
limits set out in Article 7 of Regulation 1049/2001.

 

Also, the handling of your requests involves the assessment of a very
large number of documents originating from third parties/ a Member State.
The analysis of these documents, together with the need to consult the
third parties/Member State concerned in accordance with Article 4(4) and
4(5) of Regulation 1049/2001, cannot be expected to be completed within
the normal time limits set out in Article 7 of Regulation 1049/2001.

 

Based on the above-mentioned provision, we would kindly ask you to specify
the objective of your request and your specific interest in the documents
requested, and whether you could narrow down the scope of your request
(i.e. the subject matter(s) and/or timeframe covered), so as to reduce it
to a more manageable amount of documents.

In order to help you to narrow down your requests, please note that the
following categories of documents have been identified as falling under
the scope of some of your requests:

1.      E-mails informing the applicants that were not selected for CEF
funding

2.      E-mails informing the applicants that were selected for CEF
funding and starting the grant agreement preparations

3.      Exchanges of emails relating the grant agreement preparations  

4.      Transmission of the grant agreement (draft version, signed paper
version)

5.      E-mails regarding submission of Action Status Reports and
financial statements, Certificates on the financial statement,
Certification by the Member States

6.      E-mails relating to payments (request for payment and processing
of the request for payment , interim/final payments)

 

In order to enable us to respect the time-limits of Regulation 1049/2001,
we would ask you for a swift reply to our invitation to propose a fair
solution, within five working days at the latest:

If you consider it is better to have a phone conversation, our Access to
Documents Coordinator will be glad to contact you if you indicate your
phone number.

In the absence of a reply within five working days, we will unilaterally
restrict the scope of your applications to those parts that can be dealt
with within the extended deadline of 30 working days, counting from the
registration of your application.

Moreover, as you have lodged your application via the AsktheEU.org
website, please note that this is a private website which has no link with
any institution of the European Union. Therefore INEA cannot be held
accountable for any technical issues or problems linked to the use of this
system.

Please note also that INEA is not responsible for any possible processing
of personal data by the private organisation running the AsktheEU.org
website, through which you have channelled your request. Please refer to
their privacy policy.
