Costs T-251/16
Dear Court of Justice of the European Union,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
-what are the exact amounts of costs of each party in this case ;
- who is obliged to pay them: Institution or Mr Kessler by himself?
Yours faithfully,
Veronica Quaix
Dear Madam,
Regarding your request to know who bore the costs in case T-251/16 you may
read the Order on this link:
[1]http://curia.europa.eu/juris/document/do...
I will translate the relevant par in English for you: the parties will
bear their own costs, including those relating to the proceedings for
interim measures before the Court of First Instance.
As for the amount of the costs, please note that the judicial documents
are not covered by Regulation 1049/2001 whose article 4(2) clearly provide
such exception:
"The institutions shall refuse access to a document where disclosure would
undermine the protection of: [...] court proceedings and legal advice".
Finally, should you wish to take this request further, you will find below
article 38(2) of the Rules of Procedure which describes how to proceed:
"No third party, private or public, may have access to the file in a case
without the express authorisation of the President of the General Court,
once the parties have been heard. That authorisation may be granted, in
whole or in part, only upon written request accompanied by a detailed
explanation of the third party’s legitimate interest in having access to
the file."
Kind regards,
Registry of the General

Dear GC Registry,
According the relevant par in English : the parties will bear their own costs, including those relating to the proceedings for interim measures before the Court of First Instance. Could you please specify who is obliged to pay them according to this paragraph: Institution or Mr Kessler by himself?
As for the amount of the costs, is there any subsequent decision about such payments, issued by the Court after closure of the case? is it any public information at your website about the cost? was it included in the parties’ submissions or observations?
Yours sincerely,
Veronica Quaix
Dear Madam,
Please note that the expression "the parties will bear their own costs" means that each party will pay their own costs. In other words the applicant will pay his own costs and the Commission will pay its own costs. As for the amount of the costs, no subsequent decision exists. You may access the texts governing procedure before the General Court on this page:
