thank you for your letter dated April 18, 2018.

you are writing that Council wants to extend the deadline to reply to my request by 15 working days. You are referring to Article 7 (3) of Regulation 1049/2001. It reads:

"In exceptional cases, for example in the event of an
application relating to a very long document or to a very large
number of documents, the time-limit provided for in paragraph
1 may be extended by 15 working days, provided that the
applicant is notified in advance and that detailed reasons are
given"

You have not explained why this case is an "exceptional case". On the contrary, this request is clearly on the other side of the complexity scale. It refers to one document which is not "very long". You have not given detailed reasons to the applicant. You therefor did not properly invoke the possibility to extend the deadline for handling this access to information request. An extension of the deadline cannot be granted. The original deadline remains.

Please note that as of 16 April 2018, we had been obliged to conclude that
no access could be given to the requested document beyond the partially
accessible version already available in our Public Register.

 

However, the file concerned by the document was the subject of a debate in
the General Affairs Council meeting of 17 April 2018.

 

Although this by no means necessarily implies that wider access is
possible, it cannot be excluded either, and the General Secretariat has
considered it necessary to assess the impact of the debate that has taken
place on the ministerial level.

 

As soon as this assessment is finished, you will receive a reply.

thank you for your letter dated June 6, 2018.

The extension of the deadline for a confirmatory application is possible under certain conditions, as explained in Article 8(2) of Regulation 1049/2001. These conditions are:

* It has to be an exceptional case

* the applicant has to be notified in advance

* detailed reasons have to be given.

Your attempt to extend the deadline already failed to meet the first requirement. This is not an exceptional case. On the contrary, it is one of the most non-exceptional case conceivable as it only requests one clearly defined kind of document.

The Council's decision to set up its meetings are unrelated to its obligations to comply with the deadlines imposed by Regulation 1049/2001. Its unwillingness to properly take these deadlines into account does not render this case exceptional.

Your attempt to extend the deadline is therefor void and the standard deadline of 15 workind days (starting May 15, 2018) remains.

In order to make your right to ask for a review of our decision
(confirmatory application) meaningful, the General Secretariat had to
thoroughly reassess your application.

 

This reassessment is now finished and the General Secretariat has
submitted a draft reply to delegations on 6 June.

 

The procedure requires this draft reply to be discussed by the Working
Party on Information, which is foreseen for the 12 June, see the agenda in
CM 2991/18:

The reply then needs to be formally approved by Coreper (scheduled for 19
June) and adopted by the Council (scheduled for the Employment, Social
Policy, Health and Consumer Affairs Council meeting of 21 June); you will

We apologise for the delay, but it is not possible to speed up the
treatment of your application any further at this stage.
