Dear Fernando PAULINO PEREIRA,

thank you for your letter dated June 8, 2017 in which you express your wish to extend the deadline to reply by 15 working days until June 29, 2017.

The legal basis for such an extension is Article 7 (3) of Regulation 1049/2001.

I will quote the relevant part for your convenience:

"3. In exceptional cases, for example in the event of an
application relating to a very long document or to a very large
number of documents, the time-limit provided for in paragraph
1 may be extended by 15 working days, provided that the
applicant is notified in advance and that detailed reasons are
given."

In order for you to invoke this extension, the conditions have to be met. I am afraid you failed these requirements on multiple points:

1. Not an exceptional case
This request for documents is by no means exceptional. It is rather the most basic form of access to documents request, it does not involve a very long document or a very large number of documents as suggested by the wording of Article 7 (3). There is other reason why this might be an exceptional case and I note that you are not even trying to list one.

2. No detailed reasons are given.
Your letter lists no detailed reasons whatsoever on the invocation of article 7 (3). You merely state that the General Secretariat is conducting consultations with unknown people that are somehow necessary to the examination of my request. This description, if anything, only underlines the fact that this is a standard, not an exception case. In no way does this sentence qualify as giving reasons, detailed or otherwise.

Since the requirements of Article 7 (3) of Regulation 1049/2001 are not met, you failed to invoke any extension to the deadline of my access to documents request. A voluntary extension of the deadline cannot be granted. As per Article 7 (4), a confirmatory application will be made right after the expiration of the legal deadline of this access to documents request.

Dear Council of the EU,

Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents request 'Cyber Toolbox'.

On May 13, 2017, I emailed the Council to request 4 documents identified by Council identifiers and their revisions, if applicable. On June 2, 2017, the General Secretariat of the Council confirmed the registration number of the request and the deadline for the request, June 8, 2017.

This deadline expired yesterday. Pursuant to Article 7 (4) of Regulation 1049/2001, failure by the Council to reply within the prescribed time-limit entitles me to make a confirmatory application.

Council did not invoke the extension of the time-limit for exceptional cases as provided in Article 7 (3) of Regulation 1049/2001, mainly because this is not an exceptional case. However, I received an email from Fernando PAULINO PEREIRA on June 8 in which he stated to extend the deadline to reply to my request by 15 working days. Since this attempt did not even try to meet the requirements of Article 7 (3), no change of the deadline occurred.

In my reply to Mr. PAULINO PEREIRA, I explained two of the failures to meet the requirements:

"1. Not an exceptional case
This request for documents is by no means exceptional. thank you for your letter.

I understand that you are unwilling to register my confirmatory application.

Contrary to what you wrote, you did not extend the deadline for my initial application on June 8 as your letter did not meet the requirements of Regulation 1049/2001.

I spoke with your colleague Nicole Sierens yesterday in which she stated that these extension letters are sent out routinely without any attempt to claim that this request is "extraordinary" and without detailed explanations to the applicant. A routine letter of extension by definition disproves that this is an extraordinary case. Not only do your actions contradict the spirit and letter of the Regulation, your actions also highlight that this is a deliberate attempt to circumvent the deadline mechanisms of the right for access to documents.

I maintain my confirmatory application which was sent on June 9 in accordance with the Regulation 1049/2001.

Out of abundance of caution, I note that assigning an access to documents request to a file manager who is currently on vacation does not turn this case into an extraordinary one.

I would like to maintain my confirmatory application from June 9 and I strongly urge you to send me a confirmation of having registered that confirmatory application.

I also wish to make the following remarks for the confirmatory application process:

1. Scope of the access to documents request

In my initial request from May 13, I requested :

"Any documents related to a Joint Diplomatic Response to Cyber Operations (Cyber Toolbox), including but not limited to the following documents.

* 7923/17 REV1 and other revisions, including the initial revision
* 8146/17 REV1 and other revisions, including the initial revision
* 8946/17 and other revisions
* 8907/17 and other revisions

The reply does only speak about the documents named in the lower part of the request. It is not plausible that no other documents concerning the "Cyber Toolbox" exist and they are clearly in the scope of the request.

2. Overriding public interest

An overriding public interest for a disclosure of the documents exist, not only in light of current cyber security related events and ongoing public discussions in other relevant EU institutions.

3. Faulty statements

The letter denying access claims that the documents 8146 are very sensitive by nature, a statement that is disproven by the apparent classification of these documents as LIMITE. As explained in the note on Handling of documents marked LIMITE (5847/06), LIMITE is a distribution marking, not a classification level. If they were sensitive as claimed, they would be classified with all the implications of such as classification.

The claim that information and positions contained in these documents could provide misleading information on provisional positions which ultimately have not been agreed is irrelevant to this access to documents request or, if any, would require the release of *additional* documents to convey the proper positions. It is not a factor to access to documents requests to anticipate if and how any third party will read and interpret any document and whether this interpretation is intended or shared by anyone else.

thank you for your letter dated July 20, 2017 regarding my confirmatory application.

I gather you seek to extend the time-limit for handling this confirmatory application in accordance with Article 8 (2) of the Regulation 1049/2001.

Please note that Article 8 (2) of Regulation 1049/2001 only applies to exceptional cases. You did not provide reasons why this case is in any way exception. On the contrary, you indicate that the extension of the time-limit is due to the timetable of meetings of various Council bodies. This means that the access to documents request is by any means a standard case and that the Council bodies are ill-equipped to deal with the time-limits of Regulation 1049/2001. Regardless of whether this is true in absolute terms or just relative to other institutions, Regulation 1049/2001 deals with exceptional cases, not with exceptional institutions. The timetables of Council bodies do not allow Council to invoke the extension of the time-limit.

Secondly, I would like you to note that my confirmatory application was made on June 9 following the expiration of the deadline for my initial request for documents. I ask you to have this information rectified in your records.
