Cyberattacks on EU hospitals

Dear Health and Food Safety,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- Any communication between hospitals or health authorities in the European Union and DG SANTE, since the start of the year (January 1st 2020). This could include but is not limited to, e-mails, text messages, basis documents, memos or drafts.

- Any documentation transmitted between EU member states and DG SANTE since the start of the year (January 1st 2020), detailing information on national cyber attacks, cyber threats, weaknesses of cybersecurity systems, across EU health bodies or hospitals.

- Any notification communicated from any public body within the EU to DG SANTE, concerning cyberattacks to hospitals or health authorities in the EU, and any follow up communication between the DG SANTE and the specific body in such cases.

This request extends to any information that the DG SANTE holds in relation any of the above points, including information that may have been deemed short-lived or unimportant.

Dear Mr Stolton,

of your application for access to documents, which was registered on the
same date under reference number GESTDEM 2020/4112.

 

In accordance with Regulation (EC) No 1049/2001 regarding public access to
European Parliament, Council and Commission documents, your application
will be handled within 15 working days. The time limit will expire on 29
July 2020. In case this time limit needs to be extended, you will be
informed in due course.

 

You have lodged your application via a private third-party website, which
has no link with any institution of the European Union. Therefore, the
European Commission cannot be held accountable for any technical issues or
problems linked to the use of this system.

 

Please note that the private third party running the Ask the EU website is
responsible and accountable for the processing of your personal data via
that website, and not the Commission. For further information on your
rights, please refer to the third party’s privacy policy.

 

We understand that the third party running the AsktheEU.org website
usually publishes the content of applicants’ correspondence with the
Commission on that website. This includes the personal data that you may
have communicated to the Commission (e.g. your private postal address).

 

Similarly, the third party publishes on that website any reply that the
Commission will send to the email address of the applicants generated by
the AsktheEU.org website.

 

If you do not wish that your correspondence with the Commission is
published on a private third-party website such as AsktheEU.org, you can
provide us with an alternative, private e-mail address for further
correspondence.  In that case, the Commission will send all future
electronic correspondence addressed to you only to that private address,
and it will use only that private address to reply to your request. You
should still remain responsible to inform the private third-party website
about this change of how you wish to communicate with, and receive a reply
from, the Commission.

You request clarification on the scope of my request, specifically on the first point of my enquiry. I can confirm that my request in this regard is limited to communications and information on cyberattacks to hospitals or EU health bodies.

With regards to your invitation for me to provide you with 'references and/or indications about the dates or
periods during which the documents would have been drawn up and/or persons or bodies
who would have drafted the documents,' I would prefer not to specify names or dates, as such would drastically limit the scope of the request (which is already narrow), and may, by extension, result in the unwanted consequence of documents or information falling outside the scope of my request.

We refer to our clarification letter Ares(2020)3791241 sent to you on the
20 July 2020 in which we invited you pursuant to Article 6(2) of
Regulation (EC) No 1049/2001 regarding public access to documents, to
provide us with more detailed information on the documents which you seek
to obtain, such as references, dates or periods during which the documents
would have been produced, persons or bodies who drafted the documents,
etc…

We have not received yet a reply to our request for clarifications
providing more detailed information on the document/s you would seek to
obtain. 

Therefore we will now close your pending access to documents request. 

 

If you are still interested in obtaining any Commission  document, we
invite you to submit a new request indicating which document you would
seek to obtain and further information that can help us to identify it
such as reference, title, date or period during which the document would
has been produced, persons or bodies who drafted the document.

 

You may, of course, use directly the electronic form for entering your
