Data protection derogations re processing of data relating to offences, criminal convictions or security measures
Dear Justice and Consumers,
Article 8(5) of the Data Protection Directive, 95/46/EC provides that "Processing of data relating to offences, criminal convictions or security measures may be carried out only under the control of official authority, or if suitable specific safeguards are provided under national law, subject to derogations which may be granted by the Member State under national provisions providing suitable specific safeguards". Article 8(6) then goes on to provide that "Derogations from paragraph 1 provided for in paragraphs 4 and 5 shall be notified to the Commission."
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am therefore requesting documents which contain the following information:
* Derogations under article 8(5) of the Data Protection Directive, 95/46/EC, notified by Member States to the Commission.
