Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

According to paragraph 16 of the Report of the work undertaken by the supervisory
authorities within the 101 Task Force from 28 March 2023 several SA have issued decisions. They apparently have been shared with the EDPB. Thus, I would like to get a copy of them.

Dear Mr Schmalenberger,

 

Many thanks for your e-mail and apologies for the time it took us to get
back to you, which was due to an internal restructuration that impacted
our ability to reply with the usual promptness.  

 

As you know, we are currently working on your parallel request regarding
all the submissions mentioned in the EDPB's Binding Decision 1/2023,
registered as Case 2023-19. Such request involves a considerable amount of
documents. At the moment, the EDPB Secretariat is facing a high workload
in terms of handling access to documents requests, coupled with limited
resources.  Due to this, at the moment we are not able to ensure that we
will be able to comply with the normal time limits set out in Article 7 of
Regulation (EC) No 1049/2001, if your two requests run in parallel.
Therefore, in accordance with Article 6(3) of Regulation 1049/2001, we
would like to propose as a fair solution that we deal with your request
below once we have dealt with Case 2023-19.

 

If you agree with this proposal, we will register and handle your other
request once we have dealt with Case 2023-19.

 

Please let us know whether the above proposal is acceptable for you.

limit of 15 working days, which expires today (02/08/2023).

 

An extended time limit is needed, as your application covers a document
provided by a national data protection supervisory authority that is
currently being consulted in accordance with Article 4(4) of Regulation
(EC) No 1049/2001 regarding public access to documents.

 

Therefore, on behalf of the deputy Chair, we have to extend the time limit
for another 15 working days in accordance with Article 7(3) of Regulation
(EC) No 1049/2001 regarding public access to documents. The new deadline
expires on 24/08/2023. We will try our best to get back to you before that
date. However, please note that, due to the unavailability of the deputy
chairs, we will not be able to send you the reply to your request before
16 August 2023.

Please find attached the answer from Mr. Wolfsen, EDPB Deputy Chair, with
regard to your access request.

 

Please note that, after thoroughly checking, we can confirm that the EDPB
has only received one final decision related to the work of the 101
Taskforce. This is because the SAs have channels of communication among
them, which do not run through either the EDPB or its Secretariat. Despite
the limited scope of your request, the holiday period has not allowed us
to reply to it earlier, as we originally intended. Thank you for your
understanding.
