Decryption platform, technical information

Dear European Police Office,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information regarding Europol's decryption platform (as described in its news report on 18 December 2020):

* Correspondence between Europol and the European Data Protection Supervisor related to the decryption platform;

* Correspondence between Europol and the Joint Research Centre related to the preparation, design and operation of the decryption platform;

* Documents related to past and ongoing procurement procedures of decryption tools and services from outside vendors by Europol.

Thank you for showing interest in our organisation. Europol has assessed your request and has identified:

-two documents falling within the “Correspondence between Europol and the European Data Protection Supervisor related to the decryption platform” part of the request. We regret to inform you that Europol has decided to refuse access to them on the basis of Article 4(1)(a) and (b) of the Management Board Decision laying down the rules for applying Regulation 1049/2001 with regard to Europol documents (the MB Decision on Public Access), as their disclosure would undermine the protection of the public interest as regards public security, such as the proper fulfilment of Europol’s tasks, investigations and operational activities of Member States, third parties and Union bodies, as well as the privacy and integrity of the individuals therein mentioned. These documents contain law enforcement sensitive information, including an infographic which describes in details Europol’s approach to decryption, and methods used. Public disclosure of this information would reveal methods by which Europol decrypts information and would prevent Europol from supporting ongoing and future operational activities of the law enforcement authorities in their fight against terrorism and serious crime;

-five documents falling within the “Correspondence between Europol and the Joint Research Centre related to the preparation, design and operation of the decryption platform” part of the request. We regret to inform you that Europol has decided to refuse access to them on the basis of Article 4(1)(a) and (b) of the Management Board Decision laying down the rules for applying Regulation 1049/2001 with regard to Europol documents (the MB Decision on Public Access), as their disclosure would undermine the protection of the public interest as regards public security, such as the proper fulfilment of Europol’s tasks, as well as the privacy and integrity of the individuals therein mentioned. These documents contain sensitive information that provides internal details relating to the Europol’s cooperation with the Joint Research Centre. The disclosure of the documents to the public could jeopardize the trust and mutual cooperation between Europol and the Joint Research Centre, which is essential to Europol’s activities, consequently hindering Europol’s ability to effectively perform its tasks;

-no documents falling within the “Documents related to past and ongoing procurement procedures of decryption tools and services from outside vendors by Europol” part of the request.

You may make a confirmatory application asking Europol to reconsider its position within 15 working days of receiving Europol’s reply, in accordance with Article 5(4) of the MB Decision on Public Access.
