Derogations to the ban on financial services to companies operating in the Russian energy sector
Dear Secretariat General of the European Commission,
On March 15th, the EU adopted new sanctions to respond to Russian agression on Ukraine, including a ban on financial services to companies operating in the Russian energy sector (article 3a).
Beyond Russian companies, this ban also concerns non-Russian companies that are still active in the Russian energy sector (civil nuclear being excluded). These companies can benefit from a specific derogation if they are from a EU Member State or are deemed important for supplying European energy (article 3a(2)). The EU Commission is to be informed of such derogations in the two weeks after they were granted but this information is not made public.
This ban could have a large impact as it applies to financial institutions, thus prohibiting them for providing additional financial support to companies involved in Russian energy. However, the above mentioned non-public derogations could significantly reduce the impact of the ban.
Therefore, under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
- The list of EU and non-EU companies that benefited from a derogation;
- The number of derogations granted, if possible divided by Member State.
