DG AGRI 'overlook' of its duty to receive day notes in the period 2006-2010
Dear Agriculture and Rural Development (AGRI),
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
Article 16 of Annex 2 of the Commission Decision of 15/11/2005 C(2005)4416 amending its Rules of Procedure (2005/960/EC, Euratom) ‘RULES GIVING EFFECT TO THE RULES OF PROCEDURE’ ('the day note provision') reads:
“Rules giving effect to Article 16:
Information concerning decisions adopted Day notes relating to decisions adopted by written procedure and by
empowerment procedure shall be produced and circulated by the Secretary-General within 24 hours of their approval....
”
From the application according to Regulation 1049/2001 of the undersigned (no GestDem reference number attributed so far) via asktheeu.org that DG AGRI acknowledged on 30 October - http://www.asktheeu.org/en/request/day_n... - and the subsequent correspondence, it appears that DG AGRI has 'decided' not to receive and hold copies the day notes.
Arguably, this is a disregard of a legal obligation. It raises the question whether such a disregard of a Decision of the Commission is a symptom of a bigger disregard of the Rules of the Procedure of the Commission by the administrative department DG AGRI.
I would appreciate if DG AGRI would provide me with copies of the following documents:
1. The DG AGRI internal documents according to which DG AGRI officials effectively adopted a decision to disregard the day note provision in the period 2006-2010, thereby causing DG AGRI not to receive the day notes.
2. The DG AGRI documents with which the Commissioner, or his cabinet, were notified about the 'decision' under (1) above.
3. The DG AGRI internal documents notifying the Secretariat-General that DG AGRI would no longer require to receive the day notes in the period 2006-2010, in disregard of the day note provision.
As a last remark, it is is respectfully suggested that in the event DG AGRI would be unable to release the requested documents, this would create serious doubts about whether DG AGRI does not indeed hold copies of the day notes of the period 2006 - 2010.
