The rulings of the European Court of Justice apply to Member States of the
European Union only.  The procedure whereby courts of Member States apply
the rulings of the ECJ is a cooperation procedure between those courts and
the ECJ.  When a court in a  Member State has a case before it concerning
a point of EU law and that court feels that it is necessary to apply to
the ECJ for a ruling on the EU law aspect of the case then it will do so
by  making a reference to the ECJ for a preliminary ruling.  It is the
referring court in the Member State that gives final judgment, taking
account of the ECJ ruling on the question of interpretation of EU law
raised in the reference. Only the courts in the Member States may make
such references.
