In accordance with article 5 (2) of the decision of the Court of Justice
of the European Union (CJEU) of 26 November 2019 concerning public access
to documents held by the Court of Justice of the European Union in the
exercise of its administrative functions (OJ 2020 C 45/2, 'Decision of
November 26, 2019'), you should receive a reply within a period of one
month from the date of registration. However, this time limit might be
subject to extension by the competent authority, pursuant to Article 5 (4)
of the Decision of November 26, 2019. In the present case, taking into
account the end of year holidays, and the traditional end of year
workload, we need to extend the time limit in order to best process your
application.

Dear Madam,

 

The competent authorities within the meaning of Article 8 of the decision
of 26 November 2019 (2020/C 45/02) concerning public access to documents
held by the Court of Justice of the European Union in the exercise of its
administrative functions (OJ 2020 C 45/2, 'Decision of 26 November 2019'),
have decided to respond as followed to your application n°0021/2022D of
access to documents:

 

1)      The policy on conflicts of interests of Curia staff is enshrined
in Regulation No 31 (EEC), 11 (EAEC), laying down the Staff Regulations of
Officials and the Conditions of Employment of Other Servants of the
European Economic Community and the European Atomic Energy Community
(“Staff Regulations”) and in Regulation (EU, Euratom) 2018/1046 of the
European Parliament and of the Council of 18 July 2018 on the financial
rules applicable to the general budget of the Union, amending Regulations
(EU) No 1296/2013, (EU) No 1301/2013, (EU) No 1303/2013, (EU) No
1304/2013, (EU) No 1309/2013, (EU) No 1316/2013, (EU) No 223/2014, (EU) No
283/2014, and Decision No 541/2014/EU and repealing Regulation (EU,
Euratom) No 966/2012 (see Article 61). Court staff are required to declare
any actual or potential conflict of interest at the beginning, during and
even after leaving the service. Forms are given out at the various stages
of a career or on the occasion of events justifying such a declaration.
The Court reacts on a case-by-case basis according to the information
received by staff members. For example, a colleague may be excluded from
dealing with a case if there is a risk of conflict of interest (cf.
Article 11a of the Staff Regulations).

 

2)      Please find the forms attached:

·         Declaration form according to Article 11 of the Staff
Regulations (declaration at the time of recruitment);

·         Form for members of a jury;

·         Form for exercising an external activity under Article 12b of
the Staff Regulations;

·         Form for the declaration of remuneration pursuant to Article
11(2) of the Staff Regulations;

·         Form for the declaration of an outside activity upon invalidity
pursuant to Article 13 of Annex VIII to the Staff Regulations;

·         Form for the declaration of a professional activity after
leaving the service pursuant to Article 16 of the Staff Regulations;

·         Declaration of absence of conflict of interest to be filled in
by members of opening boards and evaluation committees of requests to
participate/tenders in public procurement procedures.

 

3)      Declarations of interest are checked on a case-by-case basis.
Enforcement measures to this end are appropriate to the case.

 

We would like to draw your attention on the fact that you have the right
to submit a confirmatory application within the time limit provided for in
Article 6 of the Decision of 26 November 2019 upon receipt of this reply.
A form for this purpose is available on the Institution’s website.
