Dear Ms Izuzquiza,

I refer to your email below through which you introduce a new request for
access to documents originating from third parties. As you know we are
currently dealing with your request, registered under reference GestDem
2018/1490, which constitutes the 5th batch of your request of 15/10/2017
in accordance with the fair solution agreed upon on 30-10-2017. The reply
for the fifth batch has already been submitted for approval to the
competent persons. Therefore, we will soon register the 6th and final
batch.

As already explained, regarding third-party documents, Article 4(4) of
Regulation 1049/2001  provides that the institution shall consult the
third party with a view to  assessing whether an exception in paragraph 1
of 2 is applicable.  Therefore, the Legal Service will consult all the
concerned Member States  on their documents and give them a deadline in
order they communicate us  the conclusions of their assessment. The
consultation period referred to above adds and additional administrative 
step to the handling of the requests. Therefore, it will not be possible 
for the Legal Service to provide you with the reply within the time limit 
set by Article7(2) of Regulation 1049/2001 regarding public access to 
documents.
 
In view of the above, we would like to propose to you to treat your
request of 12 April as part of the fair solution, as a 7th batch or by
priority as the 6th batch.  This way, we will be able to conciliate your
interest with the principle of good  administration and without prejudice
to other applicants' requests. 

Please let us know if you agree with our proposal and, if yes, whether you
prefer your request of April 12 to be dealt with priority over the final
batch of your request of 15/10/2017.

We we have now registered a new request for access to documents under
reference GestDem [1]2018/3206, corresponding to the seventh batch of your
request. The new request concerns the documents filed by the Netherlands,
Poland, and the European Commission in case C-550/16. The deadline expires
on 04/07/2018. You will be informed in due time in case this deadline
needs to be extended.
