I am filing the following confirmatory application with regards to my access to documents request 'Documents on meeting between Elon Musk and Thierry Breton'.

I would like to appeal against the redaction of the names of Elon Musk from the mission report. As my initial request stated, I asked specifically for documents regarding the meeting between Musk and Breton. Redacting the rest of the mission report and then not giving access to the very subject of the request, Elon Musk, makes no sense in my opinion. Musk is the CEO of two of the world's most valuable stock market-listed companies and presumed to be the world's richest person. His meeting with Commissioner Breton, in my view, is clearly a matter of public interest. Why, otherwise, would Commissioner Breton have published a video of their meeting? The report alludes to that meeting. So it would make sense to see Elon Musks name mentioned in the report as a matter of public interest.

As to the legal points you raise, I do not see how re-redacting Elon Musk's name from the report would specifically infringe upon the integrity and privacy of his person. His conduct in regards to his companies and planned acquisition of Twitter is a subject of news coverage by most major news outlets in the world, his meeting with one of the EU's top market regulators hardly a private affair. Saying so is, in my view, a misreading both of Regulation 1049/2001 and Regulation 2018/1725 concerning data protection of EU institutions. I would also like to point out the relevant case law in the matter. In the case Commission vs. Bavarian Lager (C‑28/08 P), the matter at stake was that the Commission redacted five names of people following two express refusals by persons to consent to the disclosure of their identity and the Commission’s failure to contact the remaining three attendees. In this case, I wonder whether the Commission has attempted to reach Mr. Musk? I contend that this should happen in this case and his name de-redacted if he does not specifically object.

Parliament, Council and Commission documents ("Regulation (EC) No

Your confirmatory application is currently being handled. Unfortunately,
we have not yet been able to gather all the elements needed to carry out a
full analysis of your request and to take a final decision. Therefore, we
are not in a position to reply to your confirmatory request within the
