Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

The requests concerns

a) documents (such as agendas, Commission briefing papers and minutes) that relate to meetings as well as correspondence (such as emails, letters, faxes) between Commissioner Jutta Urpilainen, Members of her cabinet, DG INTPA members of staff, and the following:

-any representatives of the International Coffee Organization
-any representatives of the Mercosur States (Argentina, Brazil, Paraguay and Uruguay)
-any representatives of the Republic of Kenya
-any representatives of the United States of America

in relation to the negotiations on the 2022 International Coffee Agreement.

b) a list of all lobby meetings held between officials/representatives of
DG INTPA and coffee and international commodities companies since 1 December 2019, in which the 2022 International Coffee Agreement has been discussed. The list should include:
date, the name of the company attending, minutes, and the purpose of the meeting if
possible.

Please send (electronically if possible) the requested documents to [email address].
Please produce the documents on a rolling basis. At no point should the search for - or deliberations concerning - certain documents delay the production of others that have already retrieved and eligible for disclosure. In the event this application relates to a very large number of documents, I am to finding a fair solution within the prescribed limits.

May I remind you that by now, you should have already replied my documents request.

In exceptional circumstances, for example when an application relates to a very long
document or a very large number of documents, the prescribed time limit may be extended
by another 15 working days. You have already done this and those 15 working days have passed.

The response to the request is long overdue. By law, under all circumstances, the authority should have responded by now.

I am filing the following confirmatory application with regards to my access to documents request 'Documents related to International Coffee Agreement 2022'.

On 14.3.24 you wrote me that:

"We are currently working on your request. However, we have not yet been able to gather all the
elements necessary to carry out a full analysis of your request. We will not be able to send you
the reply within the prescribed time limit expiring on 18/03/2024.
The application concerns a very large number of documents and different colleagues need to be
consulted. Therefore, in line with Article 7(3) of Regulation (EC) No 1049/2001, we need to extend this
time limit by 15 additional working days. The new time limit expires on 08/04/2024."

That new time limit has expired a long time ago. Failure by the Commission to reply within the prescribed time limit is equivalent to a negative reply. In such case, the Commission must inform the
applicant in writing of his or her right to bring an action in the General Court (GC) or to
complain to the European Ombudsman (according to the conditions laid down in Articles
263 and 228 TFEU respectively).

Dear International Partnerships,

Thank you for your reply. As you can see, the initial reply in question was not sent to me on
05/04/2024 but on 19/04/2024, as indicated at the top of the document "NDH reply 2024 1062" you sent me.
I sent my reminder on 18/04/2024.

I think this indicates that you sent the reply only after I reminded you, and you did not stick to the time limits set for replying set in the Article 7 of the Regulation 1049/2001.

This is a practice that should be uprooted. People should not have to remind you of your duties as laid down in the law.
