Documents relating to the "executive working group" exploring EU-US trade talks

La demande est partiellement réussie.

Dear Madams & Sirs,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I would like to request the following documents:

1) a list of the members of the “executive working group”, which was set up by US President Donald Trump and European Commission President Jean-Claude Juncker in July 2018 to explore a path forward on trade talks between the EU and the US;

2) the mandate of the group or any other descriptions of its tasks;

3) a list of all meetings of the “executive working group” as well as of individual members in the context of the group’s mandate. The list should include the names of the individuals and organisations attending; the date; and any agendas / minutes / notes produced.

I would be very grateful if you would release documents when they are retrieved, rather than waiting until the full reply is ready.

I look forward to hearing from you.

Yours sincerely,

Dear Madams and Sirs,

thank you for your response to my request GestDem 2018/4928.

Allow me to raise the following clarification questions and suggestions:

1) On the first part of my request (a list of the members of the executive working group): could you please take the Charter of Fundamental Rights (under which EU citizens have a fundamental right to good administration) and the Commission’s Code of Good Administrative Behaviour (which, amongst other things, requires civil servants to keep proper record, to follow the institution’s normal administrative practice, to be service-minded and as helpful as possible etc) into account when considering this part of the request? I find it hard to believe that the Commission cannot disclose who – besides Commissioner Malmström and USTR Robert Lighthizer – is part of the executive working group. The public has a right to know who is involved in that group, particularly in light of recent statements from Commissioner Malmström about “short-term deliverables”, which are currently discussed in the group and for which decisions could already happen at the beginning of next year.

2) On the third part of my request (which included information on meetings of individual members of the executive working group in the context of its mandate): Can you confirm that no other meetings than the ones you have listed have taken place between the EU and the US members of the group, so, for example, no further meetings via videoconference and in other settings? And can you confirm that the group’s members have had no meetings with third-parties, including lobby groups, in which the EU-US trade talks have been addressed? Because this is what your response to this part of my request seems to indicate.

Thank you in advance for the clarifications and for re-considering the first part of my request.

Yours faithfully,

Pia Eberhardt

Dear Madams & Sirs,
I am surprised that you treat my clarification questions from 28 November as a confirmatory application - without any hint of a confirmatory application in my text.
So, allow me to stress again that my questions were meant as pure clarification questions, for which I still hope to receive a response from you - and not as a confirmatory application.
