Documents to/for DGs HOME, JUST or CNECT
Dear Sir/Madam,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
Legal Service documents concerning legislative proposals and sent to DGs HOME, JUST or Connect in 2021 (except to DG HOME in the 2nd half of 2021).
I can offer that once you have identified the relevant documents and communicated the list, I will withdraw my request regarding those that are not of interest (so you won't need to examine/redact those).
Yours faithfully,
Patrick Breyer

Dear Mr Breyer,
You have requested access to all the "Legal Service documents concerning legislative proposals and sent to DGs HOME, JUST or Connect in 2021 (except to DG HOME in the 2nd half of 2021)".
As I indicated in an email to you of 1/12/2021 concerning a very similar request, a preliminary research in our internal databases had given the result of 446 documents potentially relevant.
I appreciate your readiness to limit the request on the basis of a list of such relevant documents.
Unfortunately, the titles under which documents are registered in the database are not necessarily sufficient to decide whether a given document would fall within the scope of your request (for instance, the title may indicate a subject of the document or of the Legal Service's comments, but not necessarily the nature of the commented document - whether it is a legislative proposal or a different type of document).
Therefore, the analysis of such a request would in principle require extraction from the database of all the 446 documents (minus the documents you indicated) and their preliminary check to confirm whether they fall within the scope of the request or not.
The Regulation foresees the maximum time limit of 15+15 working days for handling the request. Given all other numerous requests we are handling at the moment (usually concerning one or several documents at most) in our very small team, even the preliminary check of 446 documents (minus etc.) within that time limit would not be possible. And if you then decide that you are interested in most of them, it would be definitely not possible to consult all the stakeholders, examine thoroughly and redact e.g. 300 documents, i.e. thousands of pages, within the regulatory time limit (even if it were doubled or tripled).
Therefore, I would be grateful if you could reconsider your request, so that it is manageable under the conditions of the Regulation. Please note that already your previous request, after the agreed limitations, proved in practice to be too extensive to be manageable within the regulatory time limits.
