Thank you for the reply and the publicly-available document, but that does not satisfy my requests which were submitted in October, over two months ago for:

- the agendas, minutes and attendance lists of any and all Economic Policy Committee meetings, which included third parties, and which discussed state-owned enterprises and/ or state assets
- the agendas, minutes and attendance lists of the meetings of the Economic Policy Committee in October 2015 and the workshop in November 2015 which explored the ownership, market and financial profiles of State-Owned Enterprises (SOEs)

My requests have been very clear and very precise and I regret the delay in DG ECFIN's response. Please can you let me know when I can expect the documents requested?

Dear Miss Cann,

 

We refer to your letter e-mails dated 13 October 2016 and 14 December 2016
in which you make a request for access to documents, registered on 18
October 2016 under the above mentioned reference number.

 

You request is for access to:

 

-       agendas, minutes and attendance lists of any and all Economic
Policy Committee meetings, which included third parties, and which
discussed State-Owned Enterprises (SOEs) and/ or state assets and in
particular

 

-       agendas, minutes and attendance lists of the meetings of the
Economic Policy Committee in October 2015 and the [ECFIN]-workshop in
November 2015 which explored the ownership, market and financial profiles
of SOEs.

 

Having examined the document/documents requested under the provisions of
Regulation (EC) No 1049/2001 regarding public access to documents, we
regret to inform you that your application cannot be granted, as
disclosure is prevented by exception/exceptions to the right of access
laid down in Article 4 of this Regulation.

 

The Economic Policy Committee (EPC) is an institutionally independent
Committee set up by the Council, namely by Council Decision 74/122/EEC; 
the Commission, with its services in DG ECFIN, provides the Secretariat of
the EPC. A subsequent Council decision (2000/604/EC)  sets out the statute
of the Committee and its Article 15 provides that:

 

"Unless decided otherwise, the proceedings of the Committee shall be
confidential. The same rule shall apply to the proceedings of its
subcommittees or working parties."

 

All documents you have asked for, except the written material discussed at
the ECFIN - workshop in November 2015 (for which you will receive a
separate reply), have to be considered as part of the proceedings of the
Committee.

 

Furthermore, the provision of all minutes would add an undue
administrative burden given the time required to trace back in time all
EPC meetings to see if they included discussions of State-Owned
Enterprises. Your specific request relating to the provision of attendance
lists can also not be provided on the basis of data protection of the
individuals.

 

We thank you for your interest in the work of the Economic Policy
Committee and apologise that we cannot be more accommodating in this
instance.
