Enquiry as to the allocation of the European Social Fund to biological females

Dear European Institute for Gender Equality,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Documentation that details the specific provisions you have put in place to ensure biological females will receive an adequate allocation of the European Social Fund, that meets their needs, now that the fund states personal data will be broken down by gender, not sex.

Documentation that discloses the reason why you have decided to break down all personal data by gender, female, male, and non binary as opposed to sex, particularly as EU Laws states sex is a protected characteristic.

Documentation that discloses the reason why you seem to have decided not to refer to sex in the latest documentation released by the European Health Fund, even though underlying EU Legislation recognises sex not gender as the protected characteristic, and rightly so, as sex is the major reason natal women and girls are discriminated against.

Documentation that discloses the reason you have decided to include the category of non-binary in the European Social Fund's allocation of funding, including any lobby groups you liaised with before making this decision.

Documentation that demonstrates any equality impact assessment you have carried out, before deciding to disregard sex in the wording of European Health Fund documentation.

Documentation that demonstrates how by recognising gender instead of sex in European Social Fund documentation, you are going to hold to Article 8 TFEU, which states you must "foster equality of treatment and opportunities between women and men in all areas", particularly in reference to the portion of funding born women and girls will be allocated.

inform you that the questions you pose in your email do not pertain our
Institute.  As a Regulatory agency of the European Union, EIGE supports 
decision making by facts and research that help to improve the work of EU
bodies, in particular, that of the European Commission.  For your
information and further knowledge about the Institute, I provide you with
the following facts on EIGE’s work, data collection activities and
objectives.

 

The European Institute for Gender Equality (hereafter referred to as
‘EIGE’ ) is a regulatory agency of the European Union, established to
contribute to and strengthen the promotion of gender equality, including
gender mainstreaming in all EU policies and the resulting national
policies, and the fight against discrimination based on sex, as well as to
raise EU citizens’ awareness of gender equality; and to raise EU citizens’
awareness of gender equality by providing technical assistance to EU
institutions, in particular the Commission and the authorities of the
Member States.

 

EIGE´s activities are guided by its strategic medium-term priorities for
2016-2018 and Single Programming Documents (SPDs).

 

The Institute (EIGE) strives to promote gender equality in all aspects of
society across Europe and beyond. Since its foundation, EIGE has developed
many innovative tools and methods as well as comparable and reliable
gender statistics. The tasks also involve contributing to improved policy
implementation by the exchange of good practices and increased dialogue
among stakeholders and EU citizens.

 

In response to your questions on the European Social Fund (ESF), this is
the European Union's main financial instrument for supporting employment
in the member states of the European Union as well as promoting economic
and social cohesion and gender equality. The ESF is one of the European
Structural and Investment Funds (ESIF), which are dedicated to improving
social cohesion and economic well-being across the regions of the Union.
The funds are redistributive financial instruments that support cohesion
within Europe by concentrating spending on the less-developed regions.

 

The particular aim of ESF spending is to support the creation of more and
better jobs in the EU, which it does by co-funding national, regional and
local projects that improve the levels of employment, the quality of jobs,
and the inclusiveness of the labour market in the member states and their
regions. One of the key objectives is to increase the participation in the
labour market of both women and men to 18% over the duration of the
funding period.

 

The European Social fund is one of the five European Structural and
Investment Funds (ESIF), over half of EU funding is channelled through the
five funds and they are jointly managed by the European Commission and the
EU countries by means of a partnership agreement.

 

DG Employment and the individual Member States are responsible for
collecting and making available the information you refer to in your

Among other initiatives is the DAPHNE programme, which focused on
activities and research to combat violence against women, involving both
Civil Society and national governments.  Currently, the main source of
funding for gender equality under the ESF is the Rights, Equality and
Citizenship Programme 2014-2020 which has as one of its stated objectives
to promote equality between women and men and gender mainstreaming and
also to prevent violence against children, young people, women and other
groups at risk.
