Establishment of Paks 2 Nuclear Plant

Dear EURATOM Supply Agency,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1) Is there any regulation that justifies when the Hungarian government makes the Paks 2 nuclear plant related documentation publicly unavailable? If there is, please point it out.
3) Is there any regulation that what part of that project must be publicly available? If there is, please also let us know.

Currently the Hungarian Parliament just voted to increase the classification from 15 years to 30 according to this:

Dear Mr. Szerb,

 

Please find hereafter an official reply on the behalf of the European
Commission:

“The classification of documents is decided by the originator of them. The
Commission and ESA – the Euratom supply agency -  should respect such a
decision made by a Member State and have put in place appropriate
procedures to deal with classified documents. In the present case, Article
4, paragraphs 4 and 5, of Regulation (EC) No 1049/2001 are applicable.
This means that the prior agreement of the originator should be sought
before the documents may be disclosed. From the facts you are aware of, it
is evident that the Hungarian authorities, if requested to grant access,
even partial, to the documents concerned, would decline it.”

 

Background information:

 

Subsequent to the agreement by the Hungarian authorities, the European
Commission is currently in the process of de-classification and will make
the Commission’s decision public as soon as possible.
