I refer to your email of 14 February 2014 (ref Gestdem 2016/758)
requesting access to documents under Regulation No 1049/2001 regarding
public access to European Parliament, Council and Commission documents.
 
In the above mentioned message you request access to documents related to
the decision of the European Commission to participate at Europride 2016
with a boat at the Amsterdam Canal Parade, including the legal basis.
 
Legal basis
 
The European Commission promotes the values of equality and
non-discrimination which are mentioned in the Treaty and raises awareness
of existing EU legislation with specific campaigns and other communication
activities.^[^[1] Between 2003 and 2010, the “For Diversity. Against
Discrimination” (FDAD) information campaign run by the European Commission
aimed to make Europeans aware of their rights and responsibilities in the
field of discrimination under the EU Equal Treatment Directives. It was
funded through PROGRESS, the EU’s employment and social solidarity
programme.^1]
 
According to Article 2 of the Treaty of the European Union "the Union is
founded on the values of respect for human dignity, freedom, democracy,
equality, the rule of law and respect for human rights, including the
rights of persons belonging to minorities. These values are common to the
Member States in a society in which pluralism, non-discrimination,
tolerance, justice, solidarity and equality between women and men prevail"
 
Article 21 of the Charter of the Fundamental Rights of the European Union
stipulates that any discrimination based on any ground such as sex or
sexual orientation shall be prohibited.
 
Several adopted EU Directives address discrimination on the grounds of
sexual orientation or mention explicitly the grounds of sexual
orientation, including the Employment Equality Directive or the Victims of
Crime Directive.
 
The participation of the European Commission at the Europride 2016 is part
of a wider EU awareness raising campaign to combat and prevent the
discrimination of LGBTI people. The campaign is one of the activities
included in the [1]'List of Actions to Advance LGBTI Equality' that was
published by the European Commission on 7 December 2015.
 
None of the activities of the campaign, including the participation at the
Europride 2016, seek to promote civil partnerships, gay marriage, same-sex
adoption or any other issue related to substantive family law, which is
the exclusive competence of the Member States. The aim of the campaign is
to improve social acceptance of LGBTI people and raise awareness of
existing EU legislation.
