- All other documents, including e-mails and internal deliberations, regarding the hunting trip organised by the European Landowners' Organization that Commissioner Hahn participated in

I would like to clarify something about your reply. You write that my request concerns "possible correspondence that does not meet the above mentioned criteria and was therefore not registered by the European Commission." Can you please state whether the e-mails in question have been deleted or just not archived? Also, can you say which of the criteria you mentioned the e-mails in question did not meet?

I am filing the following confirmatory application with regards to my access to documents request 'Exchange between the offices of Karel Pinxten and Johannes Hahn'.

You write that my request concerns "possible correspondence that does not meet the above mentioned criteria and was therefore not registered by the European Commission." You note that "the right of access as defined in that regulation applies only to existing documents in the possession of the institution, that is to say, documents
that are eligible for registration which means they must fulfil the following criteria: (i) the information relates
to the policies, activities or decisions falling within the institution's sphere of responsibility; (ii) the
information concerned is important and not short-lived; (iii) the information concerned has been drawn up or
received by the Commission."

The Commission's own Guidelines on document registration lists as examples of times to be registered (page 6) "information received from/sent to ... other EU institutions", as well as those "received from/sent to external stakeholders". I would like to note that the documents in question were indeed sent by another EU institution, the European Court of Auditors, and were in regard of an event organised by an external stakeholder, the European Landowners' Organization. This should mean they should be registered as documents falling under Regulation 1049/2001. The guidelines note that "in case the registration criteria were not applied
correctly, namely European Commission services kept unregistered documents and e-mails in their files
which should have been registered, the documents concerned are to be registered ex-post as soon as
they have been identified in the framework of a request for access to documents".

In any case, I would like the Commission to clarify whether the e-mails in question have been deleted or just not archived? Also, please state which of the criteria you mentioned the e-mails in question did not meet?

I refer to your email of 26 January 2022, registered on the same day, by
which you submitted a confirmatory application in accordance with Article
7(2) of Regulation (EC) No 1049/2001 regarding public access to European
Parliament, Council and Commission documents ("Regulation (EC) No
1049/2001"), registered under reference number above.

 

Your confirmatory application is currently being handled. Unfortunately,
we have not yet been able to gather all the elements needed to carry out a
full analysis of your request and to take a final decision. Therefore, we
are not in a position to reply to your confirmatory request within the
prescribed time limit which expired on 16 February 2022. Consequently, we
had to extend this period by another 15 working days in accordance with
Article 8(2) of Regulation (EC) No 1049/2001. The new deadline expires on
9 March 2022. However, I can assure you that we are doing our utmost to
provide you with a final reply within the next 15 working days.

 

I regret this additional delay and sincerely apologise for any
inconvenience this may cause.
