Dear Madam,
Subject: Your application for access to documents – Ref GestDem No 2017/2106

We refer to your e-mail dated 4/5/2017 in which you make a request for access to documents, registered on 5/4/2017 under the above mentioned reference number.
Your application is currently being handled. However, we will not be in a position to complete the handling of your application within the time limit of 15 working days, which expires today on 2/5/2017.
An extended time limit is needed as your application

• the application concerns a large number of documents;
• in order to retrieve the documents requested, large files have to be examined;
• (part of) the documents requested originate from third parties which have been consulted;
the application concerns documents held by different Services which must be consulted.

Therefore, we have to extend the time limit with 15 working days in accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding public access to documents. The new time limit expires on 24/5/2017.
We apologise for this delay and for any inconvenience this may cause.
Yours faithfully

Stabilité financière, services financiers et union des marchés des capitaux

Dear Madam,
I refer to your e-mail dated 5/4/2017 in which you made a request for access to documents, registered on the same date under the above-mentioned reference number.
We extended the time limit for our reply in accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding public access to documents. The new time limit is today on 24/5/2017.

We are currently looking for the documents you requested and the search is proving to be difficult especially for these documents.

As your application is broad in its scope, a significant number of files have to be examined in order to respond to your request.
Such a detailed search for and analysis of the retrieved documents cannot be carried out within the normal time limits set out in Article 7 of Regulation 1049/2001.
Article 6(3) of the above mentioned Regulation provides that in the event of an application relating to a very long document or to a very large number of documents, the institution concerned may confer with the applicant informally, with a view to finding a fair solution.
According to our first estimates, the handling of your request would take about two more months, broken down as follows:

• 3 weeks for searching and identifying the requested documents,
• 3 weeks for retrieval and establishment of a complete list of the documents identified, scanning of the documents, assessment of the content of the documents in light of the exceptions of Article 4 of Regulation 1049/2001, third-party consultations under Article 4(4) and/or 4(5) of Regulation 1049/2001, if necessary;
• 2 weeks for the final assessment of the documents in the light of the comments received, drafting of the reply, redaction of those parts of the documents to which one or several exceptions apply(ies), internal approval of the draft decision on your request, preparation of the reply and the documents for dispatch.

We therefore aim to respond to your request no later than 24/7/2017. I apologise for this delay and for any inconvenience it may cause.

Yours faithfully,

Dear Financial Stability, Financial Services and Capital Markets Union,

Thank you for your reply and for the documents. After an initial scan it seems that there are no documents relating to the acting Commissioner for Financial Stability, Financial Services and Capital Markets Union, their office and Cabinet.

Was this a mistake or do such exchanges just not exist?

Yours faithfully,

Margarida da Silva
