I am filing the following confirmatory application with regards to my access to documents request 'Feedback on Digital Services Act (DSA) Transparency Database'.

I would like to request disclosure of documents 10-18. I argue that DG Connect applied the exception regarding commercial interests in an overly broad manner. European Ombudsman rulings state that as not all information about a company is commercially sensitive, a test should be performed each time to conclude whether the exception applies (see European Ombudsman Case: 1701/2011/ANA 24 June 2013; Case: 676/2008/RT 07 July 2010.) The goal should be to determine whether disclosure would actually undermine the commercial interests of the company (see European Ombudsman Case: 1922/2014/PL 30 August 2016).

I note that the Commission is not bound by objections from the third party involved. Additionally, I would like to point to the ECJ's judgement in MSD v EMA (C‑178/18 P), in which the court held in regard to a disclosure made by the European Medicines Agency that 'a mere unsubstantiated claim relating to a general risk of misuse cannot lead to the data being considered covered by the exception'.

I ask the Commission to re-examine my request and explain how access to the documents in question could specifically and actually undermine the interest protected by that exception, and how the risk of the interest being undermined would be reasonably foreseeable and not purely hypothetical. Should it not find this to be the case, I ask for full release of the documents in question.

Further, I note that as the documents in question regard a key measure in implementation of the Digital Services Act, they should be regarded as pertaining to the institution acting in a law-making capacity, which as recital 6 of the regulation states explicitly includes its delegated powers. I argue that in understanding the decision-making of the Commission and the objections of the stakeholders provides an overriding public interest in disclosure.
