Dear Mr Sztojka,

 

In your application under Regulation (EC) No 1049/2001 you requested
"documents which contain information on how to file the appropriate
documentation within Parliament to file a complaint against an MEP in
contempt and abuse of his/her powers".

 

Initially, we wish to inform you that the scope of that Regulation, as
defined in Article 2(3) thereof, extends only to documents held by an
institution, that is to say, documents drawn up or received by it and in
its possession, and does not cover the broader concept of information. As
set out in well-established case-law of the Court of Justice of the
European Union (e.g. T-214/13, Typke v Commission), it is necessary to
maintain a distinction between the concept of a document and that of
information, for the purposes of applying that Regulation. Information may
be distinguished from a document, in particular, in so far as it is
defined as a data element that may appear in one or more documents. In
that respect, since no provision of that Regulation deals with the right
of access to information as such, it cannot be inferred that the public’s
right of access to an institution document implies a duty on the part of
the institution to reply to any request for information from an
individual.

 

Therefore, Regulation (EC) No 1049/2001 does not constitute a basis that
would require Parliament to provide legal advice, including on how to
initiate any type of legal proceedings.

I thank you for answering my inquest; however, I'm a bit confused on why the request was dismissed the matter was closed. The World Roma Federation is a registered agency in accordance with the guidelines of the European Union and we have measure to file a complaint against an MEP. The chief matter is to know the adequate process to begin. The World Roma Federation has been grievously mishandled and would like to seek restorative measures from the EU to handle this situation in accordance with its laws. Thank you.

In our previous response (below) we provided you with the reasons as to
why Regulation (EC) No 1049/2001 does not require the Parliament to
provide you with legal advice that you are seeking, as well as with the
link to the Rules of Procedure of the European Parliament, including the
Code of conduct for Members of the European Parliament with respect to
financial interests and conflicts of interest (Annex I) and the Code of
appropriate behavior for Members of the European Parliament in exercising
their duties (Annex II).

 

Since your request falls outside the scope of Regulation (EC) No
1049/2001, we have forwarded it to our Citizens' Enquiries Unit and they
will get back to you.

comment on the suitability of any person(s) elected to serve in the
Parliament.

MEPs cannot be bound by any instructions and cannot receive a binding
mandate according to the [9]Treaty on the Functioning of the European
Union and [10]Rule 2 of the Rules of Procedure. Consequently, neither the
Parliament nor its President have the authority to give instructions to
