I am filing the following confirmatory application with regards to my access to documents request 'Financial and narrative reports of the EUTFA funded project "Supporting protection and humanitarian repatriation and reintegration of vulnerable migrants in Libya" T05-EUTF-NOA-LY-02'.

First of all, as regards the protection of the right to confidentiality of individual data, obviously all data concerning people's names, as well as places and/or addresses, indications of centres, and any other information that might infringe the right to privacy or jeopardise the safety of staff can be obscured.

In fact, there is no interest in knowing sensitive information including the names of partner associations, let alone the names of staff involved in the project. Or in general any information that could harm the security of the personnel stationed in Libya as part of the project.

Therefore, I would like to stress that any potentially damaging information can be withheld, as indicated by the law on the right to access.

It should also be noted that the project in question is financed by the EUTFA, a public fund. Therefore the financial resources received by OIM for its implementation are taxpayers money.

With the aim of knowing how public money is spent, I requested the narrative and financial reports of IOM project to the Commission, as the body that directly receives these documents from IOM as the implementing body of the EU funded action action.

In wanting to know the actual use of public resources there is a clear public interest of the citizens of the European Union as tax payers. The public interest is even greater if one considers that my request refers to a project of humanitarian nature. Not also a police cooperation action, or an action of a military nature that could imply security reasons justifying the non-disclosure of documents and information.

Precisely because of the humanitarian nature of the project in question, there looks to be no ground to justify the need to prevent the disclosure of information and documents. Moreover considering the possibility to redact some of the sensitive parts.

Finally, if the disclosure of the narrative reports would constitute a prejudice - albeit with the sensitive data obscured – it remains the obligation to disclosure concerning the financial reports. In fact the financial reports containing the individual items of expenditure, in view of the public interest raised above, would be the only way to allow the knowledge on how public money has been spent.
