With respect to your questions regarding the provision of a postal
address, please find our explanations below.

 

On 1 April 2014, the postal address became a mandatory feature for the
purpose of introducing a request for access to documents.

 

The decision to ask for a postal address from applicants for access to
documents was triggered by the following considerations:

 

•             The need to obtain legal certainty as regards the date of
receipt of the reply by the applicant under Regulation 1049/2001. Indeed,
as foreseen by Article 297 of the Treaty on the Functioning of the
European Union (TFEU), […] decisions which specify to whom they are
addressed, shall be notified to those to whom they are addressed and shall
take effect upon such notification. Replies triggering the possibility for
administrative or judicial redress are therefore transmitted via
registered mail with acknowledgement of receipt. This requires an
indication of a valid postal address by the applicant;

 

•             The need to direct the Commission's scarce resources first
of all to those requests which have been filed by "real" applicants. With
only a compulsory indication of an e-mail address, applicants can easily
introduce requests under an invented identity or under the identity of a
third person. Asking for a postal address helps the Commission to protect
the administration, as well as other citizens and legal persons, from
abuse;

 

•             For similar reasons, asking for a compulsory indication of a
postal address enables the Commission services to verify whether Article
6(3) of the Regulation, on voluminous requests, is being evaded by
introducing several requests under different identities. Indeed, in its
Ryanair judgment, the General Court confirmed that Article 6(3) cannot be
evaded by splitting the application into a number of applications. The
Commission would like to point out that, in 2012/2013, it received some 57
confirmatory requests from what it suspects to be one single applicant
operating under 13 different identities;

 

•             Knowing whether the applicant is an EU resident in the sense
of Article 2(1) of Regulation 1049/2001 is a precondition for the purpose
of correctly applying the exception in Article 4(1)(b) of Regulation
1049/2001 (protection of the privacy and integrity of the individual),
which has to be interpreted in accordance with Data Protection Regulation
45/2001. Article 9 of Regulation 45/2001 requires the adequacy of the
level of protection afforded by the third country or international
organisation when transmitting personal data to third-country residents or
legal persons. It follows that, in case of requests for documents which
include personal data, the correct application of the data protection
rules cannot be ensured in the absence of a postal address enabling the
Commission to ascertain that the minimum data protection standards will be
respected.

 

All of these considerations show that the request for and the consequent
processing of a postal address is not only appropriate but also strictly
necessary for the performance of a task carried out in the public interest
within the meaning of Article 5 (a) of Data Protection Regulation 45/2001,
namely providing a smooth and effective access to documents.

thank you for your letter dated November 23, 2018, in which you express your wish to extend the deadline to reply by 15 working days until December 14, 2018.

The legal basis for such an extension is Article 7 (3) of Regulation 1049/2001.

I will quote the relevant part for your convenience:

"3. In exceptional cases, for example in the event of an
application relating to a very long document or to a very large
number of documents, the time-limit provided for in paragraph
1 may be extended by 15 working days, provided that the
applicant is notified in advance and that detailed reasons are
given."

In order for you to invoke this extension, the conditions have to be met. I am afraid you failed these requirements on multiple points:

1. Not an exceptional case
This request for documents is by no means exceptional. It is rather the most basic form of access to documents request, it does not involve a very long document or a very large number of documents as suggested by the wording of Article 7 (3). There is other reason why this might be an exceptional case and I note that you are not even trying to list one.

2. No detailed reasons are given.
Your letter lists no detailed reasons whatsoever on the invocation of article 7 (3). You merely state that the General Secretariat is handling the request. This description, if anything, only underlines the fact that this is a standard, not an exception case. In no way does this sentence qualify as giving reasons, detailed or otherwise.

Since the requirements of Article 7 (3) of Regulation 1049/2001 are not met, you failed to invoke any extension to the deadline of my access to documents request. A voluntary extension of the deadline cannot be granted. As per Article 7 (4), a confirmatory application will be made right after the expiration of the legal deadline of this access to documents request.

I am filing the following confirmatory application with regards to my
access to documents request 'Graphical Design Elements of Flash Cards in
Trade Policy'.
 
The European Commission is applying an absurdely narrow definition of
"document" that is not backed up by the Regulation 1049/2001. Applying a
reasonably broad definition of document, including less relevant ones, not
registered or archived ones such as memos, drafts, notes, emails, etc.,
the Commission could have answered to this request for documents.

Council and Commission documents, a review of the position taken by the
Secretariat-General in reply to your initial application GESTDEM

phone that I would consult with my superiors on your suggestion to set the
registration date to 14/12/2018 and to send you now a fictive 1^st holding
reply by dating it 16/01/2019.
 
I can confirm to you, that we will stay true to the actual events as they
occurred and maintain the current registration date 25/01/2019 which is
the date we became aware of your email and do not agree to sending you a
fictive holding reply.
 
I remind you that I have not at any point in time agreed to what you are

I refer to your email of 13 December 2018, registered on 25 December 2018,
through which you submit a confirmatory application in accordance with
Article 7(2) of Regulation (EC) No 1049/2001 regarding public access to
European Parliament, Council and Commission documents ('Regulation
1049/2001').

 

We have finalised handling of your confirmatory application.
Unfortunately, the decision containing the reply to your application is
now awaiting the signature of the Secretary-General. Therefore, we are not
in a position to reply to your confirmatory request within the prescribed
time limit expiring 15 February 2019.

 

Consequently, we have to extend the deadline for handling it by another 15
working days in accordance with Article 8(2) of Regulation 1049/2001. The
new deadline expires on 8 March 2019.
