Dear Secretariat General of the European Commission,

On March 25th 2022, Ursula Von Der Leyen and Joe Biden announced the creation of a joint Task Force on Energy Security. This Task Force is to have a key role in ensuring the energy security of the EU and thus holds significant influence on energy and infrastructure decisions. However, the identity of Task Force members have not been disclosed. This could be especially problematic as the various declaration from US and EU officials suggest it largely involve energy companies and lobby groups. Similarly, little information is released on the recommendations made by this group.

Therefore, under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
- The list of Task Force Members ;
- The topics discussed during meetings ;
- The involvement of the Task Force - notably through emitting recommendations - in any EU legislation or decision.

I am filing the following confirmatory application with regards to my access to documents request 'Identity of Energy Security Task Force members'.

If the DG Energy did send some information on the activity of the Task Force, it provided no information on the identity of its members nor on the precise content of the discussions. The Commission's refusal to publish a list of members is especially problematic as several companies or associations involved have direct interests in the energy sector and/or benefit from EU energy supply decisions. For example, several Task Force members may also be companies that promote projects that are listes as PCI and/or benefit from accelerated permits.

The DG said that "As concerns your request on the involvement of the Task Force in EU legislation, please note that the Task Force has a political and strategic nature, and does not issue conclusions or recommendations. Therefore, the Task Force is not involved in drafting or preparing EU legislation or decisions." If the Task Force is not involved in the drafting and preparation of EU legislation, the political and strategic discussions with the Task Force could influence the decisions and propositions of the Commission. Obviously, as the Task Force discusses issues that are directly related to EU energy security, it holds an indirect influence on EU energy policies.

In its response, the DG underlines that: "Article 4 (2) fourth paragraph foresees the possibility to override the refusal based on the protection of commercial interests if there is an overriding public interest in disclosure. In your request, you do not put forward any arguments to establish the necessity to have the data transmitted for a specific purpose in the public interest." However, there is an overridding public interest in knowing what companies play a role in defining the EU's energy supply policies and/or advise the bloc on its energy supply. In the current context, as energy drives EU inflation and becomes a preoccupation for all Europeans, but also triggers massive profits for energy companies, knowing the identity of Task Force members appears a basic democratic request and is necessary to help prevent any conflict of interest.

I hereby acknowledge receipt for these documents.
I would like to thank you for handling this request and the Commission for the disclosure of some documents important for citizens to follow the influence of companies and foreign governments on EU energy policy.
However, I would also like to stress that the points made in the Ombudsman complaint 1998/2022/NH around this lack of disclosure remain valid. Not all documents have been disclosed, and that those that have been are heavily redacted. Furthermore, the delay for handling this request - tied to a specific political context - is abnormally long.
