Thank you for contacting the European Court of Auditors (ECA).
As a foreword, please note that Regulation 1049/2001 regarding public
access to European Parliament, Council and Commission documents is not
applicable to our institution. Instead, the rules on public access to ECA
documents are set out in [1]ECA’s Decision 12/2005, as amended by Decision
14/2009 (consolidated version published in OJ C 67/1 of 20.03.2009), hence
your request has been processed in accordance therewith.
We would like to inform you that Ms von der Leyen, President of the
European Commission, consulted the ECA regarding the possibility of
creating an independent ethics body common to all EU institutions. In
accordance with Article 4.5 of the ECA’s decision, the ECA is not allowed
to disclose documents of which it is not the author to third parties. When
the ECA is requested access to a document of which it is not the author,
we “shall confirm receipt of the application and supply the name of the
person, institution or body to whom the application must be addressed”. As
a result, if you wish to access this letter, you may consider addressing
your request to the European Commission though its [2]Access to documents
webpage.
The ECA has already provided a reply to this letter, that you may find
here attached.
