Dear Mr Verbeek,
Thank you for your emails. As indicated in our previous exchanges in the
framework of your requests GestDem 2018/4306, 2018/4307 and 2018/4448, the
purpose of our proposal for a fair solution according to Article 6(3) of
Regulation 1049/2001 was to reduce the scope of your request to a
manageable amount of documents. In order to do so, we sent you a
preliminary list of identified documents for each of your requests and we
specified that we would not be able to deal with more than 25 documents in
each of them. You replied by identifying the documents of your main
interest.
Now, by introducing three new requests which taken together add up to the
same scope of your request GestDem 2018/4307 plus introducing one new
request with the same scope of your request GestDem 2018/4448 (while those
requests are still being handled), you are circumventing the objective of
the fair solution reached for the initial requests. As explained,
different steps to handle the requests have to be followed, such as the
assessment of the documents, conducting third-party consultations if
needed, drafting the reply, redacting the parts falling under one or
several exceptions of Regulation 1049/2001 and validating the reply by the
hierarchy - on top of the other functions or duties that the relevant
services are responsible for. Dealing with these new requests, in addition
to those you have already submitted on the same subject-matters, would
therefore be disproportionate and would impair other tasks of our
services, including the treatment of other applications for documents.
We will therefore not register your four new requests at this stage and we
will limit the assessment to the documents you identified as a priority
for requests GestDem 2018/4307 and 2018/4448.
