Dear Mister Rybier,
On 15 March 2022, the European Parliament registered your request for a
list of all current and past investments and jobs held by MPs that voted
on the MiCa crypto bill.
Concerning the legal background, requests for public access to documents
are processed in accordance with Regulation (EC) No 1049/2001 of 30 May
2001 regarding public access to European Parliament, Council and
Commission documents. According to Article 2, Paragraph 3 of this
Regulation, the Regulation applies to documents held by an institution,
that is to say, documents drawn up or received by it and in its
possession. Please note that an application for access that would require
the European Parliament to create a new document, even if that document
were based on information already appearing in existing documents held by
it, falls outside the framework of Regulation No 1049/2001.
Regarding your request, on 14/03/22, the Economic and Monetary Affairs
Committee adopted, with 31 votes to 4 and 23 abstentions, its negotiating
position on new rules on crypto-assets. We understand that your request
seeks information concerning this vote.
Firstly, your request addresses information on which MEPs voted on the
position. Voting results are published on the [1]webpage of the Committee
on Economic and Monetary Affairs which voted on the position. This page
incudes a Tab called ‘Meetings’ under which you can find ‘Votes’. On this
[2]page, you will find the results of votes by roll call, indicating how
each Member voted. The votes of 14 March can be retrieved from this page
and they are linked [3]here. The vote on the text as amended can be found
in chapter 1.2.
Secondly, you seek information about the background of those who voted.
The [4]Code of Conduct for Members of the European Parliament with respect
to financial interests and conflicts of interest prescribes that MEPs are
responsible for submitting a declaration of financial interests to the
President. This declaration covers aspects such as the Member’s
occupation(s) during the three-year period before they took up office with
the Parliament and their membership during that period of any boards or
committees of companies, non- governmental organisations, associations or
other bodies established in law.
