Further to our acknowledge of receipt of 18 November 2016, we would like to inform you that after carefully reviewing your application, with reference to your first question, we came to the conclusion that the process you are referring in your request has been managed by Climate KIC which it is a separate legal entity, independent from the EIT. As a result, the relevant documents are not in the availability of the EIT at this point in time.

As regards to your second question, it is our understanding that with this request, you are asking for all documents containing provisions which govern the above call for applications floated by Climate KIC UK accelerator. Please also note that this call for applications has not been managed by the EIT. If our understanding is correct, our reply to your first question should also apply to your second question. However, if our understanding is wrong, you are invited to better identify the documentation to which you are requesting access.

Having said the above, we would also like to inform that in the spirit of Regulation No 1049/2001, and in particular, Article 6 (4), with the aim to facilitate as much as possible access to the documentation requested, the EIT has forwarded your request to Climate KIC UK. Below you can find the reply to your questions:

1."The judging panel members of the Climate-KIC UK accelerator were members of the partner-led Climate-KIC UK Co-Location Centre in November and December 2014. For reasons of data protection, such partner is unable to release the specific names of individual panel members. However, the partner can confirm that such persons were appropriately qualified, being leading academics and experienced business coaches".

2. "The judging panel members were supported by a partner-led Advisory Group who was party to the applications. They acted solely in an advisory capacity to the members of the judging panel. The members of the advisory panel in November and December 2014 were active UK cleantech investors and successful UK cleantech entrepreneurs".

However, please note that the EIT is not responsible for the accuracy of the information provided by Climate KIC UK, since as mentioned above, Climate KIC is a separate legal entity and we do not retain any documentation in this regard.

I had put questions 1 and 2 to the Imperial College London which claims to
"host, co-locate and partner with" the Climate KIC.

Eventually, Imperial College London responded that Climate KIC is a separate legal entity from the College, too.

Next to "hosting, co-locating and partnering" with the Climate KIC, Imperial College staffs the Climate KIC and both rely on the same IT infrastructure, jointly (E.g. applications for Climate KIC being received at @imperial.ac.uk).

Imperial College London claims not to hold the information relating to questions 1 and 2.

3) Given the indication of concerns over data protection by the Climate KIC,
does the EIT have the power to review such documentation impartially upon a request?

In relation to your request whether the EIT has the power to review documentation concerning the call for the Climate-KIC UK accelerator the response is as follows: the legal framework, in particular, the Framework Partnership Agreement between the EIT and its KICs provides for a monitoring role for the EIT for the implementation of activities of the KIC. Such monitoring and evaluation activities are conducted independently and impartially based on objective criteria set out with the sole interest of the EIT and the EU as a whole in mind. In addition, following the end of the implementation of the programme, the EIT checks the KIC reports in the context of final payments to the KIC. We took note of the information provided by you and will take it into account for our risk assessment when selecting activities to be monitored and checked.

As for your question number 4, whether the EIT can indicate the documentation that set out and define the relationship between the EIT and Climate KIC, please note that any relation between the EIT and the KICs are governed by the following legal framework:
