Dear Legal Service,

On 2 December 2021, the Commission decided to close the infringement case against Germany concerning the German Constitutional Court's PSPP judgment of 5 May 2020 (INFR(2021)2114).

Since the case is closed, on the basis of the second sentence of Article 11(1) and Article 42 of the Charter, as well as Article 2(1) of the Regulation 1049/2001, I am requesting the following documents:
— letter of formal notice sent to Germany in case INFR(2021)2114,
— response to the letter of formal notice sent to the Commission in case INFR(2021)2114.

I am also requesting that these documents be sent in their original language, and also in English if the Commission has a translation in that language.

The reply to your request is currently in preparation. However, in view of
the number and nature of the requests for access to documents the Legal
Service is dealing with, we will not be in a position to complete the
processing of your request within the extended time limit of 15 working
days, which expires today, 25 January 2022. Furthermore, your request
concerns documents of which the Commission is not the author. According to
Article 4(4) of Regulation (EC) No 1049/2001, the Commission has to
consult the third parties from which the documents originate. This
consultation procedure adds an additional administrative step and time
factor to the handling of your access request.

 

Nevertheless, we do our outmost to send you our reply as soon as possible.
