List of authorisations for BIT negotiations requested by EU member states

La demande est partiellement réussie.

Dear Trade (TRADE),

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

a list of bilateral investment treaties (BITs), for which EU member states seeked Commission authorisation in order to negotiate them and/ or conclude negotiations since the "grandfathering" regulation (Regulation 1219/2012) came into force on 1 January 2013.

Yours faithfully,

Pia Eberhardt

Dear Madams & Sirs (TRADE),

thank you very much for this information.

I would like to ask one question of clarification: Is my understanding correct that you could not include information about notifications submitted by other EU member states because all other member states indicated that this information was confidential when they submitted the notifications?

Yours faithfully,

Pia Eberhardt

Dear Mrs Eberhardt,

This is correct. In accordance with Article 14 of Regulation 1219/2012 we were unable to disclose information contained in the notifications which Member States have indicated as being confidential.
