Dear Sir ,
We refer to your e-mails dated 17/10/2022 in which you make requests for
access to documents, registered on 18/10/2022 under the above mentioned
reference numbers.
Your applications are currently being handled. However, we will not be in
a position to complete the handling of your application within the time
limit of 15 working days, which expires on 10/11/2022.
An extended time limit is needed to carry out internal consultations
regarding the disclosure.
Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding

However, I want to object to the redaction of the last paragraph/sentence of the minutes document. Considering how crucial the Commission's view of market mechanisms is in this debate, I think it's in the public's interest to disclose these arguments.

Dear Mr. Rudl,
We acknowledge receipt of your email of 1 December 2022.
As already explained in our Director General's letter to you, the section
of the Internal Report you are referring to had to be redacted for the
following reason: pursuant to Article 4(3) of Regulation (EC) No.
1049/2001, access to the documents drawn up by the Commission shall be
refused if the disclosure of the documents would seriously undermine the
Commission's decision making process (e.g., about an ongoing transaction
which is the case of the redacted part of the Internal Report concerned).
The disclosure of such information would inevitably discourage companies
from providing this information in an open and detailed manner, which
risks seriously affecting, prolonging and complicating the ability of the
Commission to take into account such information for its policy-making and
enforcement activities. In view of the foregoing, that part of the
Internal Note has been redacted based on the exception related to the
protection of the Commission's decision-making process, set out in Article
4(3) of Regulation 1049/2001.
I hope this clarifies the Commission position.
