Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
1- all correspondence (including email, SMS, private twitter and WhatsApp) since 1st February 2022 between Commissioner Simson, and/or her cabinet and/or officials from DG Energy with representatives from Wintershall, Uniper Fortum, OMV, RWE, TotalEnergies, ExxonMobil, Shell, BP, Eni, Repsol, Galp in which the EU’s response to Ukraine invasion, particularly the rePower communication was discussed.
2- any briefings prepared for Commissioner Simson, and/or her cabinet and/or officials from DG Energy for meetings since 1st February 2022 with representatives from Wintershall, Uniper Fortum, OMV, RWE, TotalEnergies, ExxonMobil, Shell, BP, Eni, Repsol, Galp in which the EU’s response to Ukraine invasion, particularly the rePower communication was discussed.

I would like to make clear I prefer you produce the documents on a rolling basis.
At no point should the Commission’s search for—or deliberations concerning—certain documents delay the production of others that the Commission has already retrieved and elected to produce.
To the extent possible, we prefer the documents in electronic format. Documents that cannot be sent in electronic format should be sent to Corporate Europe Observatory, Rue d’Edimbourg 26, 1050 Brussels.
Should my request be denied wholly or partially, please explain the denial or all deletions referring to specific exemptions in the regulation. Also I expect the partial release of documents, in case of partial exemption according to article 4.6.
I reserve the right to appeal.

However, we will not be in a position to complete the handling of your

Despite a reminder, this was never dealt with. By law, under all circumstances, DG ENER should not only have acknowledged the delay but have responded by now.
