Meetings between DG FISMA and lobbyists

Dear Sir/ Madam,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, we are requesting the following documents:

- a list of meetings of Directorate-General for Financial Stability, Financial Services and Capital Markets Union (DG FISMA)officials/representatives (excluding the European Commissioner, his Cabinet and the director-General) and interest representatives (including companies, onsultancies and law firms,trade/business/professional associations, think tanks and NGOs) between December 1st 2014 and today.

We would like the list to include the following information:
the date of the meeting,
which companies/organisations were present at the meeting,
names of the lobbyist(s) that were present,
the sector they represented (business, NGOs, academia, think tanks),
the name and job title of the European Commission officials that were present (e.g. head of unit,etc.),
and also the issues discussed, if possible in sufficient detail so as to identify the dossiers or policy initiatives covered.

We are requesting a list in order to avoid submitting a much broader request for minutes and other reports of meetings with interest representatives, which could require a large amount of effort from the Commission's side.
One of the ALTER-EU member organisations received a similar list of such meetings from DG MARKT in the summer of 014.[1]

There is clearly a high public interest in transparency over the Commission's interactions with outside interest groups.

Subject: Your application for access to documents – Ref GestDem No 2015/3846

We refer to your email dated 16 July 2015 in which you make a request for access to documents, registered on 22 July 2015 under the above mentioned reference number.
Your application concerns the following document:

- a list of meetings of Directorate-General for Financial Stability, Financial Services and Capital Markets Union (DG FISMA)officials/representatives (excluding the European Commissioner, his Cabinet and the director-General) and interest representatives (including companies, consultancies and law firms, trade/business/professional associations, think tanks and NGOs) between December 1st 2014 and today.

We have prepared for your attention the most exhaustive table possible of meetings with officials of DG FISMA (from 1st December 2014 to 16 July 2015). This table contains 456 meetings which were held in our Directorate General. The preparation of this table has represented a considerable work for our Directorate General.

The document to which you have requested access contains personal data, in particular names of civil servants of DG FISMA above the level of Director and names of visitors. These have been erased.

Pursuant to Article 4(1) (b) of Regulation (EC) No 1049/2001, access to a document has to be refused if its disclosure would undermine the protection of privacy and the integrity of the individual, in particular in accordance with Community legislation regarding the protection of personal data. The applicable legislation in this field is Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data .

When access is requested to documents containing personal data, Regulation (EC) No 45/2001 becomes fully applicable .
According to Article 9(1) of this Regulation and unless the conditions of Article 9(6) of the Regulation are met, personal data shall only be transferred to recipients, other than Community institutions and bodies, which are not subject to national law adopted pursuant to Directive 95/46/EC, if an adequate level of protection is ensured in the country of the recipient or within the recipient international organisation and the data are transferred solely to allow tasks covered by the competence of the controller to be carried out.
We consider that, with the information available, the fulfilment of these conditions has not been established. Therefore, we are disclosing the documents requested expunged from this personal data.

In case you would disagree with the assessment that the expunged data are personal data which can only be disclosed if such disclosure is legitimate under the rules of personal data protection, you are entitled, in accordance with Article 7(2) of Regulation 1049/2001, to make a confirmatory application requesting the Commission to review this position.

Such a confirmatory application should be addressed within 15 working days upon receipt of this letter to the Secretary-General of the Commission at the following address:

Thank you very much for the list you have disclosed under my access to EU documents request.

It would be great if you could please answer my only question about the PDF in order to understand it more clearly:

Between meetings 11 and 12 of the first page there is a 'floating' row that reads "GUERSENT Olivier; MERLIN Martin; Assistant 1;" under INTERNAL PARTICIPANT column. Does this row refer to meeting 11 or meeting 12?

And is this the same with all such 'floating' rows (eg does this 'floating' row always relate to the meeting above, or the one below ... see between meetings 23 and 24, 26 and 27, 42 and 43, etc etc)?

If the document had lines, it would be easier to read :) In any case, thank you for the document!
