Dear Ms Vaughan,

 

By email of 5 March 2020, you filed a request for information on the
ground of Regulation 1049/2001 regarding public access to European
Parliament, Council and Commission documents. You requested documents
which contain the following information:

 

“All documentation (including but not limited to all email correspondence,
attendance lists, agendas, background papers, and minutes/notes) relating
to the meetings listed below:

 

1. Between the Permanent Representation of Netherlands to the EU and the
ACEA on the 13th December 2019

 

2. Between the Permanent Representation of Netherlands to the EU and Shell
on the 3rd February 2020”

 

In reply to your request, I would like to inform you as follows.

 

Regulation 1049/2001 regulates the right of any citizen of the European
Union (EU) to access to documents of the European Parliament, Council and
Commission. As you are not requesting documents of one of the EU
institutions, the mentioned regulation is not applicable to your request.

 

As you are requesting documents of the Permanent Representation of the
Netherlands to the EU, the Permanent Representation has – together with
the Legal Affairs Department of the Ministry of Foreign Affairs of The
Netherlands  assessed whether the requested documents exist and, if so, if
these documents can be disclosed on the ground of the Government
Information (Public Access) Act (Wet openbaarheid van bestuur; WOB) of The
Netherlands.

 

The conclusion is that the Permanent Representation of the Netherlands to
the EU does not have the documents you requested. There are no documents
for both meetings, because the appointments for the meetings were made by
telephone, and, probably important to mention, the meeting with ACEA was
in the end canceled. In this regard, it is probably also important to
mention that the WOB provides for the disclosure of information contained
in documents. If such documents do not exist, disclosure is not possible.
