Members of "The European Judicial Network in Civil and Commercial Matters"

La demande est partiellement réussie.

Dear Justice and Consumers,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Background:
The European Commission refers frequently to the The European Judicial Network in Civil and Commercial Matters like Michael Shotter from the EU Commission DG JUST on 26th February 2015 at the JURI workshop in Brussels.
https://archive.org/details/20150226_EP_... (see B05) or: https://archive.org/download/20150226_EP...

Hereby I quote:
"Niovi Ringou, Deputy Head of Unit, Unit A1 “Civil Justice Policy” (European Commission, Directorate General Justice), spoke about “The European Judicial Network in Civil and Commercial Matters.” “This is a flexible, non bureaucratic structure, an informal way of acting.” She explained that the European Judicial Network (EJN)5 provides a wide range of information on EU and national law in EU Member States. Created by a Council decision of 2001, the network has operated since December 2002. “Today, the EJN is an important tool for courts and contributes to a genuine area of justice in Europe,” she said. The network today includes 512 members from all areas of justice, including professional associations, and holds six meetings per year, which provides a platform for discussion. National contact points ensure easy access to national law. In September 2011, a set of recommendations was elaborated on how to deal with requests."

Question:
As this is regulated by EU law I would like to know:
(1) the names of all members (around 528 or more),
(2) their nationality
(3) their position within the ECJ
(4) an organisation chart of the ECJ
(5) special memberships within the ECJ like committee on Families, Children, Adoption but also dat protection and electronic commerce
(5) the organization where the EJB members earn their money
(6) the position in the organization they work for
(7) the current country of citizenship of each member
(8) special positions of the people like chair positions of public funded organization, private organization etc
(9) the budget of the ECJ
(10) the conferences where the ECJ was part of
(11) special relations/connections of the ECJ members to the EU especially the European Commission and there especially to DG JUST.
(12) details about the regular meetings (around 6) per year with:
(12.1) the EJB members who joined the individual meeting,
(12.2) other peoples names and positions outside ECJ who where there
(12.3) the location of the meeting
(12.4) the agenda of the meeting
(12.5) the expenses/fees for the Members to join the meeting
(12.6) who got or settled the profit or less of the individual meetings
(12.7) the decisions of the meeting,
(12.8) video recordings and tape recordings of the meetings
(12.9) Special regulations/outcome in reference to EC2201/2003, the Hague Child returns and child contact enforcements
(12.10) Details about "the financial and logistical support in relation to the Joint Conferences" through the European Commission
(12.11) access through the civil society to these meetings ?
Re #12.1 to 12.11 I would like to have a detailed breakdown of each individual meeting since 2002. If this causes a delay I request that at minimum 2009 to 2014 should be given within the 15 working days answering period.
Also I would like to remind if parts of these questions cannot be answered (e.g. lawyers have to investigate on this request) all the other questions have to be answered within the 15 day period.
Therefore I request a detailed answer for each individual question within the 15 working days.

Yours faithfully,
Klaus Zinser

Subject: Your application for access to documents – Ref GestDem No 2015/1298

Dear Sir,

We refer to your e-mail dated 03/03/2015 in which you make a request for access to documents, registered on 03/03/2015 under the above mentioned reference number.
Your application is currently being handled. However, we will not be in a position to complete the handling of your application within the time limit of 15 working days, which expires on 24/03/2015.

An extended time limit is needed as your application
• concerns a large number of documents and
• in order to retrieve the documents requested, large files have to be examined.

Therefore, we have to extend the time limit with 15 working days in accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding public access to documents. The new time limit expires on 17/04/2015.

We apologise for this delay and for any inconvenience this may cause.

Yours faithfully,

European Commission

There should be now delays caused and taxpayers money used for lawyers who try to delay and try to avoid answers.

Kindly publish a list with the names of all members (in total 528 or more) NOW !

-> Question #(1) NOW and the other questions later.

Yours faithfully,

Klaus Zinser

Dear Justice and Consumers,

the already extended 17th April 2015 has passed and still nothing.

Start now and let me know the 512 or more names of the members of this - maybe anonymous, hidden and intransparent - network.

Also let me know if you are in contact with your legal service department what could be interpreted as attempt to avoid an answer.

Yours faithfully,

Klaus Zinser

Dear European Commission,

hereby I request to get the individual names of all the people who are members of the European Judicial Network and also all the individual names of the people who came to the individual meetings.

This means hereby I request that my questions (1), (12.1) and (12.2) will be answered. These People are public servants, often judges and to avoid that the European Citizens get the impression that decisions are made behind closed doors whilst it is a fundamental right that court hearings are open to the public, I request to get to know the names.
The same for the people and members of the Central authorities.

When going through the documents it was mentioned that there were pictures taken. European citizens should get to know the people who make the court decisions.

Therefore I make hereby this confirmatory application.

"In case you would disagree with the assessment that the expunged data are personal data which can only be disclosed if such disclosure is legitimate under the rules of personal data protection, you are entitled, in accordance with Article 7(2) of Regulation 1049/2001, to make a confirmatory application requesting the Commission to review this position."

Kindly forward the request to:
European Commission Secretary-General
Transparency unit SG-B-4 BERL 5/327

or by email to: REMOVED

Yours sincerely,

Klaus Zinser
