I am filing the following confirmatory application with regards to my access to documents request 'Meta's "subscription no ads" plan'.

As regards your refusal under Article 4(3), first subparagraph, I contend that you have not sufficiently demonstrated that disclosure of the document would "seriously undermine" the institution's decision-making process, as is required under this exception. I find the grounds given, which refer to "ongoing initiatives, policy processes and implementation of legislation" to be vague and hardly apt to justify refusal.

In this context, I would like to point out the General Court decision in the De Capitani case (T-540/15), in which the Court accepted that a risk of external pressure could constitute a legitimate ground for restricting access to documents related to the decision-making process, but “the reality of such external pressure must … be established with certainty, and evidence must be adduced to show that there is a reasonably foreseeable risk that the decision to be taken would be substantially affected owing to that external pressure”.

I therefore ask the Commission to specify to which ongoing initiatives, policy processes and implementation processes it refers, and why they would be undermined by disclosure. In case these can not be demonstrated with sufficient clarity, I ask for disclosure of the documents in question.

Furthermore, I argue an overriding public interest in disclosure. Decisions on data processing by Meta affect millions of users in Europe, and enforcement decisions are likely to have a huge fundamental rights impact. Non-disclosure and the lack of possibility for public scrutiny therefore constitute a clear harm to public debate.
