Ministerial Dinner with IT Companies

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1. All documents relating to the ministerial dinner on 8 October 2014 with IT firms including Google, Facebook, Twitter and Microsoft.

Specifically, I also request access to:

2. Any agenda, briefing document, presentation, correspondence or other document prepared in advance of the dinner, including any correspondence with the firms in question;

3. Any document or presentation circulated or presented at the dinner itself;

4. Any document recording details of the discussion at the dinner itself, including any report or summary of the discussion, list of agreed actions or follow up items.

Dear Home Affairs (HOME),

I am writing to request an internal review of Home Affairs (HOME)'s handling of my FOI request 'Ministerial Dinner with IT Companies'.

In that request I sought access to:

"1. All documents relating to the ministerial dinner on 8 October 2014 with IT firms including Google, Facebook, Twitter and Microsoft.

Specifically, I also request access to:

2. Any agenda, briefing document, presentation, correspondence or other document prepared in advance of the dinner, including any correspondence with the firms in question;

3. Any document or presentation circulated or presented at the dinner itself;

4. Any document recording details of the discussion at the dinner itself, including any report or summary of the discussion, list of agreed actions or follow up items."

In his letter of 10 November 2014 Mr. Luyckx states that "Being an informal meeting, no specific document has been prepared for the event".

I find very surprising the claim that Ministerial dinners are so spontaneous and informal that there is no paperwork surrounding them.

At a minimum there must exist at least the following documents which would fall within the scope of my request:

(i) Correspondence between the two Commissioners arranging the dinner.

(ii) Correspondence with the firms in question arranging their attendance.

(iii) A list of attendees.

(iv) A note of the discussions.

(v) A note of the agreed actions.

I note that the press release of 9 October 2014, which is referred to in Mr. Luyckx's response, itself specifically states that "The participants discussed various possible ways of addressing the challenge. It was agreed to organise joint training and awareness raising workshops for the representatives of the law enforcement authorities, Internet industry and civil society." It is clear, therefore, that there is some record of the discussions and the agreed actions.

I would be obliged, therefore, if you would now review the handling of this request.
