Move by Darren Ennis from Commission to MHP

Dear Human Resources and Security (HR),

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting all documentation relating to Commission decisions made about the job move by Mr Darren Ennis from being spokesperson to Commissioner Ashton to starting to work for MHP Communications. Specifically, I would like to receive all Mr Ennis's job titles during his time at the Commission, the date of his application for permission to move to MHP, the date of the Commission response, whether or not the job move was approved, the reasons given, and any conditions that the Commission attached to the approval of this external post. I would also like to receive all correspondence and emails concerning this topic.

I refer to my Access to Document request Gestdem 2011-5983 which I tabled on 24 November 2011:

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting all documentation relating to Commission decisions made about the job move by Mr Darren Ennis from being spokesperson to Commissioner Ashton to starting to work for MHP Communications. Specifically, I would like to receive all Mr Ennis's job titles during his time at the Commission, the date of his application for permission to move to MHP, the date of the Commission response, whether or not the job move was approved, the reasons given, and any conditions that the Commission attached to the approval of this external post. I would also like to receive all correspondence and emails concerning this Topic.

I have received Mr Cesare Onestini's response dated 17 January 2012 and was very surprised by it. I have tabled similar, if not identical requests to Commission DGs regarding other specified individuals, and have received the documents requested, including requests 2011-3966, 2011-4405, 2011-4407, 2011-4617, 2011-4618 and 2011-4780.

As a result, I do not understand why, in this particular case, the documents cannot be released to me. Other Commission DGs have not considered that there was a problem to disclose the equivalent documents. I would like you to review this urgently.

I should also point out that I am not requesting private data such as personal email addresses or telephone numbers. All the documents which I request concern Mr Ennis in his professional capacity as a (then) official at the European External Action Service.

You have asked for a justification regarding this request. Corporate Europe Observatory is a research and campaign group promoting greater accountability and transparency within the EU institutions. We have had a long-standing interest in the way in which Article 16 of the Staff Regulations is implemented within the Commission, and particularly how potential conflict of interest are evaluated and dealt with. Thus we have made a series of requests on these matters to a variety of different DGs. I consider that these are matters of public interest.

I look forward to hearing from you and to receiving the documents requested as soon as possible. My original request was tabled on 24 November and the period to respond has already been extended once. This request is now rather urgent.

This has been very confusing! My orignal request was passed to EEAS to handle. I was sent some information but no documents and now they refuse to release the documents to me because the data subject objects, even though I think the EEAS is not obliged to follow this. The confusion was added to in that their final letter to me was attached to another A2D request to EEAS! My appeal options have now apparently been used up.
