Movement of children to another country ? 1. The Hague Abduction 2. EC 2201/2003

La demande a été rejetée par Justice et Consommateurs.

Dear Justice (JUST),

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

I. How many children have been abducted in one of the EU member states since January 2008.

Kindly give figures on:
- the number of cases,
- the number of children,
-the EU state the children have been brough/abducted to. This for all the cases where the The Hague regulation was applied

II. Further, how often has the EC 2201/2003 regulation for children, that have been brought to another country where one parent was left behind, has been applied since January 2008 ?
This question should be answered in detail for each year:
- how many children
- how many cases
- what was the gender of the Parent who moved to another county ,
- to what country have the children been brought,
- what was the age of the children ?
Also I would like to know if the children still have regular contact to the left behind parent after 1 year, after 2 years ... (for every year).

This request is also in reference of the consultation of the applicability of the EC2201/2003 (Brussels IIa) regulation until 18th June 2014 where every citizen can take part

Dear Justice (JUST),

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Justice (JUST)'s handling of my FOI request 'Movement of children to another country ? 1. The Hague Abduction 2. EC 2201/2003'.

As there is one case where it can be proved that the EU Commission has been made aware of, there must be documents. Nearly for sure there are other cases. Out of this reason I request an internal review.

A full history of my FOI request and all correspondence is available on the Internet at this address: http://www.asktheeu.org/en/request/movem...

Yours faithfully,

Vinzenz Zinser

Dear Justice (JUST),

thank you for the feedback information.

On Question I:

When you look at the refered part in the EU document:

"In 2008, 706 return applications were made between Member States. Statistics show that the overall
return rate between Member States was 52% in 2008 while it was 39% when the requesting State was a
third State: Statistical analysis of applications made in 2008 under the Hague Convention of 25 October
1980 on the Civil Aspects of International Child Abduction — Part II

Regional Report, Prel. Doc.
No 8 B

update of November 2011 for the attention of the Special Commission of June 2011,
available at http://www.hcch.net. "

I found:
http://www.hcch.net/index_en.php?act=pub...
and the document from 2011:
http://www.hcch.net/upload/wop/abduct201...

------

HAGUE CONVENTION OF 25 OCTOBER 1980 ON THE CIVIL ASPECTS OF INTERNATIONAL CHILD ABDUCTION

1980 Hague Child Abduction Convention and the
1996 Hague Child Protection Convention
------

which refers to Data in 2008. I have contacted them to see if there is a more recent document.

Question: Does the EU have more recent statistics ?

On Question II:
"II. Further, how often has the EC 2201/2003 regulation for
children, that have been brought to another country where one
parent was left behind, has been applied since January 2008 ?
This question should be answered in detail for each year:
- how many children
- how many cases
- what was the gender of the Parent who moved to another county ,
- to what country have the children been brought,
- what was the age of the children ?
Also I would like to know if the children still have regular
contact to the left behind parent after 1 year, after 2 years ...
(for every year)."

I can't see an answer from your side.
Surprisingly the The Hague Agreement seems to have " ..As in previous surveys, the vast majority of applications made under the Convention in 2008 were for return (84%) compared with the proportion of access applications (16%)." (Page 70 of the above mentioned document), too.

Question: When will Part II of this FOI be answered ?

Yours faithfully,

Vinzenz Zinser

Dear Justice (JUST),

I am waiting for the reply. Deadline is 2nd October 2014.
