Dear Communications Networks, Content and Technology,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- A list of which member states have notified to the European Commission the implementation of the provisions on penalties, as required by article 6 of regulation (EU) 2015/2120

- The content of all member states' notifications of the provisions on penalties, as required by article 6 of regulation (EU) 2015/2120

- The content of any communication from the European Commission to member states about the provisions on penalties from article 6 of regulation (EU) 2015/2120.

I'm looking forward to receiving your reply.

All the best,
Peter Teffer

PS: I have noticed that the Commission sometimes send both a digital and a paper version by registered mail of your response. Please only send paper versions of your communication if you do not intend to send a digital copy. The physical mail always reaches me later than e-mail, so paper versions are environmentally wasteful and somewhat inefficient.

Yours faithfully,

Dear Mr Teffer,

Thank you for your request dated 10/04/2017. We hereby acknowledge receipt of your application for access to documents registered on 10/04/2017 under the reference number GestDem 2017/2218.

In accordance with Regulation (EC) No 1049/2001 regarding public access to European Parliament, Council and Commission documents, your application will be handled within 15 working days.

The time limit will expire on 05/05/2017. In case this time limit needs to be extended, you will be informed in due course.

You have lodged your application via the website. Please note that this is a private website which has no link with any institution of the European Union. Therefore the European Commission cannot be held accountable for any technical issues or problems linked to the use of this system.

Regarding your request to not send paper versions, please note that the decision to send registered letters to the applicant was triggered by the need to obtain legal certainty as regards the date of receipt of the reply by the applicant under Regulation 1049/2001. Indeed, as foreseen by Article 297 of the Treaty on the Functioning of the European Union (TFEU), […] decisions which specify to whom they are addressed, shall be notified to those to whom they are addressed and shall take effect upon such notification. Replies triggering the possibility for administrative or judicial redress are therefore transmitted via registered mail with acknowledgement of receipt and therefore an indication of a valid postal address by the applicant.

Best regards,

Bernadett BERCZELI

Dear Mr Grussmann,

The extended legal deadline to reply to my request registered under GestDem 2017/2218 has expired. I'd like to ask you kindly to respond to my request without delay.

All the best
Peter Teffer

Dear Mr Grussmann,

In your letter dated 31 May 2017, you informed me of the difficulty to comply with my request by the legal deadline. You wrote that you expected "a few days of delay". But instead of a few days, two weeks have now gone by since that letter. A response is now long overdue.

If receiving permissions from individual member states is problematic, please consider sending the documents in tranches, instead of holding off replying until the very last member states has granted you the permission to release the information.

Yours sincerely,
Peter Teffer
