Dear Migration and Home Affairs,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- All documents (targeted questionnaires, concept notes, powerpoint presentations, etc.) for the preparation and execution of the targeted consultations, meetings and workshops with stakeholders organised in the framework of the revision of the Advance Passenger Information - API Directive (as mentioned in the Inception Impact Assessment: Ares(2020)2916519);
- The number of targeted consultations, the number of meetings and the number of workshops broken down by the categories of stakeholders (the competent authorities at Member State level; international and European industry organisations in the transport (air, sea, land) sector; airlines, land and sea carriers, airport and seaport authorities, private IT solutions providers, passenger associations, and EU institutions, bodies and agencies) before the release of the proposal for a revision of the API Directive;
- The compilation and summary of the results of the targeted consultations, meetings and workshops.

Dear Ms Berthélémy,

We are writing concerning your request for access to Commission documents
registered on 25 October, under case number EASE-2022-6064.

We are currently working on your request. However, we have not yet been
able to gather all the elements necessary to carry out a full analysis of
your request. We will not be able to send you the reply within the
prescribed time limit expiring on 17 November.

As you may know, the Impact Assessment is a very complex exercise. The
reply to your request requires large files to be examined with a
significant amount of time necessary to retrieve all documents.

Therefore, in line with Article 7(3) of [1]Regulation (EC) No 1049/2001,
we need to extend this time limit by 15 additional working days. The new
time limit expires on 8 December 2022.

I am filing the following confirmatory application with regards to my access to documents request 'Preparation Revision API Directive'.

I submitted my request for access to documents on 25/10/2022 which was registered on 25/10/2022 under the case number 2022/6061. On 8 November you informed that you needed to extend this time limit by 15 additional working days. The new time limit expired last week, on 8 December 2022. On 8 December, you informed me again that you were late with the processing of my request. This further delay is not properly justified even considering the number of documents requested.

Curiously, this is also postponing the sending of the requested documents to after the European Commission's new proposal for an updated API Directive is set to be published (13 December 2022). However, the disclosure of the documents related to the preparation of the impact assessment of this proposal should not be influenced and obstructed by the date of publication of said impact assessment.
