Dear Mr Teffer,               

We refer to your e-mail dated 8 May 2017 in which you make a request for
access to documents.

You request access to “the rental contract(s) of the building(s) the
agency occupies”.

We have identified the following documents falling under the scope of the
request:

1.       Lease agreement for the De Haagse Veste building;

2.       Lease agreement for the ARC building;

3.       Lease agreement for the new premises;

Having examined the documents requested under the provisions of the
[1]Eurojust Decision to adopt rules regarding public access to Eurojust
documents of 13/07/2004 , I have come to the conclusion that they may be
partially disclosed. Some parts of the document/documents have been
blanked out as their disclosure is prevented by exceptions to the right of
access laid down in Article 4 of the Eurojust Access to Documents
Decision:

Ø  According to Article 4(1)(a) third indent, Eurojust shall refuse access
to a document where disclosure would undermine the protection of the
public interest as regards “international relations”.  

Ø  According to Article 4(2) first indent, Eurojust shall refuse access to
a document where disclosure would undermine the protection of “commercial
interests of a natural or legal person, including intellectual property."

The redacted parts of the documents contain information covered by the
exceptions mentioned above. Namely, Eurojust cannot reveal the rental
price for the buildings it occupies as disclosure of this information
would undermine the protection of  the public interest with regard to the
international relations of the Netherlands with other countries and
international organisations. Disclosure would expose information that has
been agreed exclusively between the Netherlands and Eurojust and are very
specific to Eurojust’s housing situation.

Moreover, revealing this information would undermine the protection of the
commercial interests of the other party of the contract, in this case The
Netherlands.  The disclosure of the rental price payed by Eurojust for
renting the buildings would reveal financial information exclusively
negotiated and agreed between the Netherlands and Eurojust and its
disclosure would undermine the position of The Netherlands in future
negotiations.

Therefore, we  have  concluded  that  only  partial  access  to  the 
aforementioned  document  can be granted. 

In addition, please note that in accordance with Article 4(1)(b) of the
Eurojust Access to Documents Decision, the personal data in the documents
have been expunged.

In accordance with Article 7(4) of the Eurojust Access to Documents
Decision, you are entitled to make a confirmatory application requesting
Eurojust to reconsider its position. Such a confirmatory application has
to be addressed within 30 working days upon receipt of this reply to the
Administrative Director of the Eurojust at the following email address:

Finally, we would like to inform you that should you wish to obtain access
to the annexes to the lease agreements, you could submit a separate access
to documents request.
