Dear Enlargement (ELARG),
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
Between the period of 23 to 27 of April, 2012, an expert team was in Macedonia in order to make reports in the key areas that were marked is priorities in HLAD (High Level Accession Dialogue between the government of Republic of Macedonia and the European Commission). The experts were hired by the European Commission and they were in Skopje on the dates mentioned above on this request. I would like to have a copy of all the reports. Also, I would like to know if those reports were introduced to other bodies on the EU. Besides those information, I need to know what are the costs for those experts, including fees, travel costs and etc ( acompanied with prove).

I am writing to request an internal review of Enlargement (ELARG)'s handling of my FOI request 'reports by EU experts on HLAD'. The reference number of my request is GestDem 2012/5146 send on 12/11/2012. I received the answer by the Commission with one day delay after I wrote to them that the dead line expired and they did not even inform me that there will be a delay. But, never mind, I will not complain about that. I've asked two questions and I got my answer only about one. My request to get the experts reports made in the Republic of Macedonia in April 2012 between 23 and 27 of April was denied. The reason they gave me is that the reports are not avaliable for public because the disclosure of those documents would harm the realations of the European Union and the Former Yugoslav Republic of Macedonia.
Those reports and experts analyses provided by the TAIEX instrument are used to assesses the beneficiary country progress in different areas such as justice and home affairs.
As a citizen of Macedonia I am very confused with this answer. Do we have the right to know how the progress is measured? if we don't than how is it regulated? Every year we have the progress report and it is public. So, if the expertise provided by the EU member states is relevant than why it is a secret? Do the citizens of EU have the right to know? Those reports are payed with their money for sure. Also, if a citizen from a member state country wants, for an example, to invest in a candidate country, does he have the right of access to the expertise made by EU member state experts in order to know what is happening really in that country in the area of judicary, public administration and other areas relevant for starting bussiness. What is more important - the interest of the EU citizens or harming the relations with the candidate country? Also, this raise a suspicion. If expert reports are classified than I have the right to suspect in the relevance of the evaluation of the progress of the country. Or why a simple progress report would harm the relations between the EU and the candidate country?
That is way I am asking you to review my request again.
