Dear European Data Protection Board,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

All data protection supervisory authorities are required to submit a copy of their annual reports to the Board.

Please provide a list of all reports received under Art 59 GDPR from data protection supervisory authorities in Germany, especially including authorities that fall under Art 85 (2) GDPR and Art 91 (2) GDPR; in case no such list exists, please provide a copy of all such reports received so far.
In the alternative, please provide a list of all supervisory authorities in German, particularly including the ones highlighted above.

Many thanks in advance.

Yours faithfully,
Sven Braun

Dear Mr Braun,

Thank you for your message.

Before registering your request, we would like to ensure that we understand it correctly: if there is a list of the reports you refer to, you are not requesting access to the individual reports received, but only to this list. Could you please confirm whether or not this understanding is correct?

Thank you very much in advance for your feedback.

Best regards

Dear Mr. Braun,

Please find attached the answer from Mr. Karadjov, EDPB Deputy Chair, with
regard to your access request.

Sincerely,

The EDPB Secretariat

Dear Mr. Karadjov,

many thanks for your message dated 14 January 2021 and the information provided as an answer to my request.

With regards to the list provided, I am seeking clarification: My request highlighted data protection supervisory authorities (SA) that fall under Art 85 (2) GDPR and Art 91 (2) GDPR. The list provided is limited to national SAs, excluding e.g. the catholic or protestant church SAs, or SAs in public service broadcasting in Germany.
Can you please confirm that none such reports have been received by the EDPB and that the list attached to your letter is an exhaustive list of all reports received by SAs in Germany, national or other?

Many thanks in advance.

Yours sincerely,
Sven Braun

We confirm that the only reports we have received from German authorities are the ones which appear on the list provided (at federal and Land level), on the basis of Article 59 GDPR. We have not received reports from the other authorities that you have mentioned.
