Request for information regarding the Comission's assessment of the National Air Pollution Control Programme submited by Poland in June 2019.

Dear Environment,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

In June 2019 Poland submitted the final version of the National Air Pollution Control Programme as required by the National Emission Ceilings Directive (2016/2284).

Polish environmental organisations dealing with ambient air quality have serious doubts concerning the quality of the Polish NAPCP. Most importantly, it does not contain any new measures or additional measures leading to reduction of harmful emissions. The NAPCP in its current form is merely a superficial summary of existing air protection policies and legislation.

Thus there are reasons to believe that Poland fulfilled its obligation to adopt a NAPCP ostensibly, as the said document will not have any real impact on reducing emissions of air pollutants.

Therefore I would like to ask whether the Commission has already assessed and accepted the Polish NAPCP's as complying with the NEC Directive or if there is any further communication ongoing between the Commission and Polish government, that should lead to amednment of the said NAPCP?

Thank you for your message of 15 June by which you ask whether the
Commission has already assessed and accepted the Polish National Air
Pollution Control Programme (NAPCP) as complying with Directive (EU)
2016/2284 on the reduction of national emissions of certain atmospheric
pollutants (NEC Directive), or if there has been any further communication
between the Commission and the Polish government in view of an amendment
of the said NAPCP.
 
We would like to inform you that reviews of NAPCPs, including the Polish
one, have been prepared with the  support of  a consultant of the
Commission and are available since the 26 June 2020 on the webpage of the
Directorate-General for Environment under the following link:

On that webpage you will moreover find reviews of Member States’ latest
emission projections and a related horizontal report covering both NAPCP
and projections reviews, prepared by the consultant.
 
The Commission has provided an assessment of Member State NAPCPs as part
of its Report to the European Parliament and the Council on the progress
made on the implementation of Directive (EU) 2016/2284 on the reduction of
national emissions of certain atmospheric pollutants of 26 June 2020,
which is available on the same webpage.
 
As regard amendments of the NAPCP, Directive (EU) 2016/2284 sets out in
Article 6(3) that NAPCPs have to be updated at least every four years.
Furthermore, according to Article 6(4) of the Directive policies and
measures have to be updated earlier in case of non-compliance or a risk of
non-compliance with the emission reduction commitments established in the
Directive.
 
There has been no further communication between the Commission and the
Polish Government in view of an amendment of the Polish NAPCP at this
point.
