I am filing the following confirmatory application with regards to my access to documents request 'Request for minutes of meetings by staff'.
In your letter dated 27 January 2017, you write that no documents were found in relation to the two meetings between BUSINESS EUROPE and Inge Bernaerts on 9 December 2014 and 14 July 2015. Could you please check again? I am interested in any document pertaining to these meetings, whether they are minutes, supporting documents, recorded presentations, reports or conclusions of the meetings.
In your letter you also indicate that you cannot disclose the documents and minutes of the meeting between Marianne Thyssen and BUSINESS EUROPE, citing the exceptions laid down in Article 4 of Regulation 1049/2001 as well as articles 152, 154 and 155 of the TFEU.
For the latter, I don't see how the disclosure of the documents would undermine the capacity of BUSINESS EUROPE to act as a social partner, nor how it would undermine the decision-making process of the Commission. Your letter fails to give specific and effective arguments supporting this claim. Can you please explain in more details what you mean?
BUSINESS EUROPE is officially registered in the transparency register as non-profit aisbl (association internationale sans but lucratif). Therefore, how could the disclosure of the documents "undermine the protection of commercial interests of BUSINESS EUROPE", as you write in your letter, since BUSINESS EUROPE has no commercial interest of its own? Please explain.
As you know, the European Court of Justice has already ruled (as in Joined Cases C 39/05 P and C 52/05 P Sweden and Turco v Council [2008]) that the institutions need to be more specific when using the exceptions of article 4 and give clear details as to how the disclosure of documents would “specifically” and “effectively” undermine interests. I would therefore ask you to be more specific in your answer.
Furthermore, there is clear overriding public interest in disclosing the documents, and failure to do so could only reinforce the suspicion around the Commission's decision-making process and independence towards lobby groups. BUSINESS EUROPE is a heavyweight in the Brussels decision-making process, and its meeting with commissionner Marianne Thyssen comes at a time of important reforms in terms of labour rules, employment and social affairs in Europe. It is important for the public to understand what the employers organisation have to share with the Commissioner overseeing these changes, and whether or not the reforms are independent from any other interest than the European public interest. I trust that the commission understands the necessity of transparency on matters that directly concern workers and citizens in Europe.
